There shall be established and maintained just and equitable rates or charges for the use of the wastewater (sewerage) collection and treatment system and the services rendered by the Sanitary Board of the City of South Charleston (Sanitary Board), to be paid by the owner of each and every lot, parcel of real estate or building that is connected with and uses such works by or through any part of the sewerage system of the City, or that in any way uses or is served by such works. Such rates or charges shall be sufficient in each year for the payment of proper and reasonable expense of operation, repair, replacement and maintenance of the system, and for the payment of the sums required by Bond Covenants to the Municipal Bond Commission or other dedicated accounts. No such rates or charges shall be established until after a public hearing at which all the users of the system and other interested parties shall have had an opportunity to be heard concerning the proposed rates and charges.
The Sanitary Board of the City of South Charleston shall cause all rates and charges to be billed and collected on a just and equitable basis. The Sanitary Board shall cause to be maintained a record of all charges and disbursements in accordance with the Code of the State of West Virginia, Rules and Regulations of the West Virginia Public Service Commission and generally accepted accounting practices. The Sanitary Board shall cause an annual audit to be made of the financial condition of the wastewater collection and treatment system and shall report the same to the South Charleston City Council.
