3-2-7: CLASSIFICATION OF LICENSES:
Every person engaged in the retail sale of alcoholic liquor in the village shall pay an annual license fee. Such licenses shall be divided into the following classes:
   A.   Class A; Restaurant: The class A liquor license shall authorize the sale of alcoholic liquor for consumption on the premises only of a restaurant or an entertainment facility with a restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor.
   B.   Class B; Package Sales: The class B liquor license shall authorize the sale of alcoholic liquor in its original package for consumption off the premises where the primary business purpose is other than the sale of alcoholic liquor, including, but not limited to, the sale of medications, food, and other items for use and consumption off the premises. The display of such alcoholic liquor for sale shall be in a separate area of the premises that may be easily observed by a store clerk.
   C.   Class C; Club: The class C liquor license shall authorize the sale of alcoholic liquor by clubs, as defined in section 3-2-1 of this chapter for consumption on the premises only.
   D.   Class D; Restaurant - Limited Beer And Wine: The class D liquor license shall authorize the sale of beer and wine for consumption on the premises only of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of beer and wine.
   E.   Class E; Restaurant - Beer And Wine Package Sales: The class E liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor and further authorizes the sale of beer and wine in its original sealed package or container for consumption off the premises.
   F.   Class F; Restaurant - Brewpub: The class F liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor and further authorizes the sale of beer that is produced on the premises in a sealed container for consumption off the premises.
   G.   Class G; Restaurant - Wine Package Sales: The class G liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor and further authorizes the sale of wine in its original sealed package or container for consumption off the premises.    H.   Class H; Specialty Shop: The class H liquor license shall authorize the sale of wine, chocolate martinis and chocolate flavored beer for consumption on the premises of a chocolatier in conjunction with the sale of chocolate and beer flavored chocolates and further authorizes the sale of wine and chocolate flavored beer in their original sealed package or container for consumption off the premises in conjunction with the sale of gift baskets or packages that include chocolate or beer flavored chocolates. For purposes of this subsection, a "chocolate martini" shall be defined as an alcoholic beverage containing vodka and a chocolate flavored liqueur and may contain additional flavored liqueurs and other nonalcoholic ingredients. The licensee shall submit a list of specific chocolate martinis, including specific ingredients, to the local liquor commissioner for prior approval. Not more than five (5) chocolate martini varieties and not more than six (6) chocolate flavored beer varieties shall be approved for service and listed on the menu during any period of time.    I.   Special Event License: The special event license shall be a license which shall authorize the sale of beer and/or wine for consumption only on the premises where sold, for an event of an educational, fraternal, civic, religious, or not for profit corporation, club, or organization, and for a period not exceeding four (4) days. No such permit, however, shall be issued or granted except upon proof of adequate dramshop (host liquor liability) insurance in effect during the period for which each such special event license shall be issued.
      1.   Each application by such an organization for a special event license shall contain the same information required of a "club" as defined in section 3-2-1 of this chapter. All applications shall specify the person or persons responsible for the custody and sale of the beer and/or wine, the dates and hours of service, and shall indicate the nature of the organization (e.g., charitable, civic) and the character of the event or events to which the permit applies. Each application by a not for profit corporation shall contain a copy of the applicant's recorded articles of incorporation and a copy of the applicant's most recent annual report filed with the secretary of state of the state of Illinois.
      2.   All applications shall state the time period for which the license shall be applicable and shall state whether the license is for solely an outdoor or an indoor location.
      3.   The special event license shall authorize the retail sale of alcoholic liquor by the specified organization at a picnic, outing, festival, fundraising event, or such other similar special occasion for consumption on the premises or within the area specifically designated in such license. The local liquor control commissioner shall also establish the hours of operation of the special event license which may be more restrictive than the hours of operation established in section 3-2-14 of this chapter.
      4.   The fee for such special event license shall be as specified in section 3-2-8 of this chapter, but no separate application fee shall be charged. No more than one such special event license shall be issued in any calendar year to any one applicant.
   J.   Extended Hours Supplemental License: The supplemental license for extended hours shall authorize the sale of alcoholic liquor until two o'clock (2:00) A.M. each day, provided the licensee has a valid liquor license in good standing pursuant to class A, D, E, F, or G that has been operating for at least one year without incident or problem.    K.   Special Use Permit License: A special use permit liquor license shall allow a holder of a village of South Barrington retail liquor license to transfer a portion of its alcoholic liquor inventory from its license retail premises to a designated site in the Village for sale and consumption at a special event. A special use permit liquor license must be obtained for each special event, and each special event shall not exceed a period of fifteen (15) days in duration.
      1.   Each application or request by a retail liquor licensee for a special use permit liquor license shall specify the person or persons responsible for the custody and sale of alcoholic liquor, the dates and hours of service, and the character of the special event to which the permit applies. Each application or request for a special use permit liquor license shall include a certificate of dramshop insurance, required by State law or local ordinance whichever is greater, naming the Village of South Barrington as an additional insured and setting forth the exact location of the special event.
      2.   A special use permit liquor license shall authorize the retail sale of alcoholic liquor by the specified retail liquor licensee for consumption on the premises of the special event or within an area specifically designated in the special use permit liquor license request or application.
      3.   A special use permit liquor license shall be issued by the Village of South Barrington Local Liquor Control Commissioner.
      4.   No more than twelve (12) special use permit liquor licenses shall be issued in any calendar year to any one applicant/licensee.
      5.   An applicant for a special use permit liquor license shall also apply for and be issued a State of Illinois special use permit liquor license issued by the Illinois Liquor Control Commission for the location and dates of the special event.
      6.   No special use permit liquor license shall be issued to any person, partnership, corporation or club that does not first satisfy all requirements for issuance of a Village of South Barrington retail local liquor license as provided in section 3-2-5 of this chapter.
      7.   The Local Liquor Control Commissioner may, in his/her discretion, limit the hours of the sale or delivery of alcoholic liquor at the special event.
   L.   Class L: The Class L liquor license shall authorize the sale of beer, wine, and limited canned cocktail spirits for consumption on the premises only of an art/painting studio. Limited cocktail spirits shall be no more than two (2) varieties, at or under nine percent (9%) alcohol content, and available for sale and consumption by registered patrons. Such sales and consumption shall be limited to registered patrons assembled on the premises for the purpose of attending art or painting classes offered by an art studio, arts and crafts school or similar business.
      1.   The service of beer, wine, and limited cocktail spirits shall only be allowed during the time at which the facility is conducting art and/or painting classes.
   LL.   Class LL: The Class LL Liquor License shall authorize the sale of beer and wine for consumption on the licensed premises only of an axe throwing establishment.
      1.   Food will be advertised and available by third party that delivers to the license premises.
      2.   Such sales and consumption shall be limited to registered patrons assembled on the premises for the purpose of attending axe throwing offered by the business.
      3.   Sale of beer and wine shall be an accessory to the axe throwing establishment and shall only be sold during the hours of 3 p.m. and 10 p.m. Monday through Thursday, 2 p.m. through 11 p.m. Friday and Saturday, and 2 p.m. through 8 p.m. on Sunday.
   M.   Class M; Restaurant - Wine And Liqueur Package Sales: The Class M liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor and further authorizes the sale of wine and limoncello liqueur in their original sealed packages or containers for consumption off the premises.
   MM.   Class MM; Restaurant And Liqueur Package Sales: The Class MM liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a food service establishment or restaurant where the food service component of the business is operational during the hours of sale and delivery of alcoholic liquor and further authorizes the sale of Limoncello liqueur in their original sealed packages or containers for consumption off the premises.
   N.   Class N; Banquet Facility: The Class N liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a banquet facility.
   O.   Class O; Theater: The Class O liquor license shall authorize the sale of alcoholic liquor for consumption on the premises of a theater, as defined in section 3-2-1 of this chapter.
   P.   Class P; Salon/Barbershop: The Class P liquor license shall authorize the sale of beer, wine, hard cider and hard seltzer for consumption on the premises of a salon/barbershop, as defined in section 3-2-1 of this chapter. The sale of beer, wine, hard cider and hard seltzer shall be incidental to the primary business at the premises and shall be limited to patrons of the salon/barbershop as part of salon or barbershop services being rendered to those patrons. In addition, patrons shall not be served more than three (3) alcoholic beverages during salon or barbershop services. No beer, wine, hardcider or hard seltzer may be sold, given or delivered to persons who are not receiving salon or barbershop services. (Ord. 2013-989, 6-4-2013; amd.
