Council, pursuant to Civil Service Commission Rule 4(h), hereby declares its intent that the position of the Assistant Chief in the Fire Department shall be an exempt, non-civil service classified position. The Mayor, pursuant to Article V, § 5(b), of the City Charter, shall appoint the Assistant Fire Chief upon the recommendation of the Fire Chief. The Assistant Fire Chief may be terminated for just cause by the Mayor pursuant to Article V, § 5(b), of the City Charter, with recommendation for termination by the Fire Chief. The Assistant Fire Chief may also be transferred or reduced by the Mayor with recommendation for such transfer or reduction by the Fire Chief. If the Assistant Fire Chief was appointed to the position from the classified civil service status in the Fire Department, the Assistant Fire Chief shall revert to the classified civil service status held by him or her at the time of his or her appointment if he or she is transferred or reduced.
