§ 12-3-5 APPROVAL OF PRELIMINARY PLAT BY TOWN COUNCIL.
   (A)   Actions of Town Council. After the hearing on the preliminary plat, the Town Council shall approve, disapprove, or approve subject to modification, the plat. If approved, the Town Council shall affix its signature to the plat. If recommended for approval with modifications, or disapproved, the Town Council shall attach to the plat a statement of the reasons for such action. In any case, a notation of the action taken and requisite reasons therefor shall be entered in the records of the town.
   (B)   Time limit for acting upon recommendations. The Town Council shall act on the recommendation within 32 days after the recommendation is formally presented to the Town Council. The Town Council shall determine whether the preliminary plat shall be approved, approved with modifications, or disapproved, and shall give notice of its decision to the developer. If approved, the members of the Council shall affix their signatures to the plat. If approved with modifications or disapproved, there shall be attached to the plat a statement of the reasons for such actions signed by the members of the Town Council.
