A. Enforcement: The provisions of this article shall be enforced by the town police department or by a person, or persons, as appointed by the board of trustees.
B. Liability Of Owner: For the purpose of prosecution for violation of this article, it shall not be necessary in order to obtain a conviction to prove notice or knowledge on the part of the owner, possessor, harborer, or keeper of the dog or dogs in question that such dog(s) was violating any of the provisions of this article at the time and place charged; it being the purpose and intent of this article to impose strict liability upon the owner, possessor, harborer, or keeper of any dog for the action, conduct, and condition of the dog.
C. Penalty For Violation Of Noninjury Or Damage Provisions: The fine for any violation of the following provisions of this article shall be forty five dollars ($45.00) for any first time violation within a period of three hundred sixty five (365) days:
1. Section 4-1A-2, "License And Vaccination Requirements", of this article.
2. Section 4-1A-3, "Imported Dogs", of this article.
3. Subsection 4-1A-4A, "Vaccination Required", of this article.
4. Section 4-1A-5, "Unlawful Acts Involving Dogs", of this article, except for subsections 4-1A-5B, C, and G of this article.
5. Section 4-1A-7, "Female Dogs In Heat", of this article.
D. Penalty For Violation Of Those Provisions Resulting In Injury, Property Damage, And Loss: The fine for any violation of subsections 4-1A-5B, C, and G of this article, and for a second, or additional, violation of any other provisions of this article within a period of three hundred sixty five (365) days, shall be set at the discretion of the municipal court judge subject to the limitations set forth in section 1-4-1 of this code. Further, the court may impose restitution obligations, as a part of the findings and order, upon any owner, possessor, harborer, or keeper of a dog which causes injury, damage, or other loss to another as a result of the dog's actions and the owner's violation of this article.
