§ 152.15  PERMIT REQUIRED FOR EXCAVATING, GRADING, OR FILLING; EXCEPTIONS.
   (A)   No owner of any property or any person in possession or control of any property shall hereafter permit or allow any excavating, grading, or filling to be done on the property unless a permit has been issued therefor.
   (B)   No permit shall be required for any excavation that does not exceed three feet in vertical depth at its deepest point, or for any fill of less than 50 cubic yards of material, or for any fill that does not exceed three feet in vertical depth at its deepest point and has no slope at any point steeper than five horizontal units of measurement per one vertical unit of measurement, or for any excavation below finish grade for basements and footings of buildings, swimming pools, or other underground structures authorized by valid building permits.
