949.04 CONTAINERS REQUIRED; LOCATION; PLASTIC BAGS PERMITTED FOR CERTAIN USES.
   (a)   Each householder or other resident unit located in the Village shall provide refuse, trash and garbage containers of a type designed to be leak-proof and to prevent the intrusion of rodents and insects, and such unit shall subscribe for service from a Village-licensed sanitation hauler to pick up all of its solid waste except leaves and brush picked up by the Village during specified times, and individually composted yard waste.
   (b)   The containers required by subsection (a) hereof shall be kept clean, disinfected, covered and in good repair in such a way as to prevent the same and their contents from becoming offensive, noxious or dangerous to the public health of the inhabitants of the Village.
   (c)   Until such time for pick-up, as set forth below, each resident shall keep his or her refuse containers in the garage or abutting the garage, or dwelling if there is no garage, and not in the front yard, as such yard as defined in Section 1103.28 of the Silver Lake Zoning Code. Any portion of driveways located in the front yard shall be included in the area defined as front yard.
      (1)   Setback Service and Bag Service: Containers and bags designated for single-bag service may be placed behind the setback line and in view from the street no earlier than 6:00 p.m. the day before pickup. All rubbish must be placed in closed containers or in bags designated for single-bag service; regular carry-away plastic bags are not permitted except as permitted in subsection (d) below.
      (2)   Curbside Service (Full): Containers may be placed immediately adjacent to the public way no earlier than 6:00 p.m. the day before pickup. All rubbish must be placed in closed containers or in bags designated for single-bag service; regular carry-away plastic bags are not permitted except as permitted in subsection (d) below.
      (3)   Curbside Bag Service: Bags designated for single-bag service may be placed immediately adjacent to the public way no earlier than 6:00 p.m. the day before pickup. Only bags designated for single-bag service may be placed in the public way; regular carry away bags are not permitted except as permitted in subsection (d) below.
   All refuse containers must be removed from the public way, per Section 949.04 (c) by 10:00 p.m., on the day of pickup and returned behind the setback line.
   (d)   This section shall not prevent the placing of leaves and lawn clippings in carry-away plastic bags immediately adjacent to the public way provided they are not placed earlier than 6:00 p.m. of the day before the day of the regular scheduled pickup.
