202.02 DEFINITIONS; RULES OF CONSTRUCTION.
   In the construction of these Codified Ordinances and of all ordinances and resolutions of Council, the following rules of construction shall be observed, unless such construction would be inconsistent with the manifest intent of Council:
      (1)   City. "City" means the City of Sidney, Nebraska, a municipal corporation.
      (2)   City Clerk-Treasurer. "City Clerk-Treasurer" or "Clerk-Treasurer" means the Clerk-Treasurer of the City.
      (3)   City Inspector. "City Inspector" means the City Inspector of the City, which office is created in Section 1422.01 of the Building and Housing Code and who was previously known as the Building Inspector.
      (4)   City Jail. "City Jail" means "County Jail." When so construed and when the City exercises its right to use the Jail of the County for the confinement of persons liable to imprisonment under the ordinances of the City, the City shall be liable to the County for the cost of keeping such prisoners.
      (5)   City Treasurer. "City Treasurer" or "Treasurer" means the Clerk-Treasurer of the City.
      (6)   Code. "Code" or "this Code" means the Codified Ordinances of Sidney, 1977.
      (7)   Council. "Council" means the Council of the City.
      (8)   County. "County" means Cheyenne County, Nebraska.
      (9)   Gender; Number. The masculine gender applies to and includes the feminine and neuter genders and the plural applies to and includes the singular and vice versa.
      (10)   Health Officer. "Health Officer" means the City Manager or his representative authorized by him in writing.
      (11)   In the City and of the Cite. "In the City" and "of the City" mean within the corporate limits of the City as the same are now or may be hereafter established.
      (12)   Joint Authority. Words purporting to give authority to three or more officers or other persons shall be construed as giving such authority to a majority of such officers or other persons, unless it is otherwise declared.
      (13)   Month. "Month" means a calendar month.
      (14)   Oath. "Oath" includes an affirmation in all cases in which by law an affirmation may be substituted for an oath. In such cases the words "swear" and "sworn" are equivalent to the words "affirm" or "affirmed."
      (15)   Or and And. "Or" may be read "and," and "and" may be read "or," if the sense requires it.
      (16)   Owner. "Owner," applied to a building or land, includes any part owner, joint owner, tenant in common, tenant in partnership or joint tenant of the whole or of a part of such building or land.
      (17)   Person. "Person" includes natural persons, artificial persons such as corporations, copartnerships and associations, and all aggregate organizations of whatever character.
      (18)   Preceding and Following.  "Preceding" and "following" mean next before and next after, respectively.
      (19)   Public Place. "Public place" means any public street, alley, square, highway, grounds, house or premises; or any hotel, restaurant, boardinghouse, grocery, saloon, garden, workshop or other place, or part of the same, to which people usually resort, or have a right to resort for business or pleasure.
      (20)   Sidewalk. "Sidewalk" means any portion of the street between the curb lines or the lateral lines of the roadway and the adjacent property lines, intended for the use of pedestrians.
      (21)   Signature and Subscription. "Signature" and "subscription" include a mark when a person cannot write, provided that the mark is made in the presence of two subscribing witnesses.
      (22)   State. "State" means the State of Nebraska.
      (23)   Street and Highway. "Street" and "highway" mean the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
      (24)   Tenses. Words used in the past or present tense include the future as well as the past and present.
      (25)   Wholesale Dealer. "Wholesale dealer" and "seller at wholesale" include manufacturers of any product who sell such product to other persons for the purpose of resale to consumers thereof.
      (26)   Written and in Writing. "Written" and "in writing" mean any representation of words, letters or figures, whether by printing or otherwise.
      (27)   Year. "Year" means a calendar year.
