8-5-5: FENCES REQUIRED:
   A.   Temporary Fence During Construction: During the construction of an inground pool and when no work is being performed, the excavation and construction site must be completely surrounded by a temporary fence not less than four feet (4') in height, of sufficient strength to prevent access to the construction area. This temporary fence shall be removed upon completion of the permanent enclosure required in subsection B of this section.
   B.   Permanent Fences For Inground And Aboveground Pools:
      1.   Swimming Pools: All outdoor private residential and temporary swimming pools shall be completely surrounded by a fence of not less than four feet (4') in height, separated at least six feet (6') from the pool and of sufficient strength to prevent access to the pool. This fence shall be constructed so as not to have any openings, holes or gaps larger than four inches (4") in any dimension except for doors and gates. A dwelling house or accessory building may be used as part of such fence. All gates or door openings through the required fence shall be designed to permit locking and shall be kept locked when the pool is not in actual use or when the pool is unattended. All such gates or doors shall be designed to be self-closing and self-latching. The latches shall be placed at least four feet (4') above the ground elevation or otherwise made inaccessible to small children. An approved pool cover shall be installed during those periods when use of the pool is discontinued.
      2.   Aboveground Swimming Pools: Aboveground private residential swimming pools with self-provided fencing standing at least three feet (3') above the pool deck will be allowed without separate additional fencing; provided, that the self-provided fencing is of sufficient strength and required height to prevent access other than through a gate or door. Aboveground private residential swimming pools having stationary ladders, stairs or ramps shall be equipped with locking devices to prevent unauthorized access. All fencing required herein shall be subject to all other ordinances of the village relating to the installation and maintenance of fences 1 . (Ord. 14-1749, 10-28-2014)
