8-5-1: DEFINITIONS:
When used in this chapter the following words and terms shall have the meanings ascribed to them in this section:
   PERSON: Includes any individual, occupant of a residence, lessee or property owner, as well as any individual, partnership, corporation or business entity engaged in the business of constructing private residential swimming pools.
   PORTABLE SWIMMING POOL: A temporary receptacle of water or an artificial pool of water with a maximum diameter of eighteen feet (18') and a maximum water depth of eighteen inches (18") intended to be used for wading and requiring no water filtration, pumping or water treatment systems and intended to be emptied daily or after use.
   PRIVATE RESIDENTIAL SWIMMING POOL: A receptacle of water or an artificial pool of water, whether aboveground or level with the ground, having a maximum depth of over eighteen inches (18") and all appurtenant equipment which is used or intended to be used for swimming by the owner or lessee thereof and family and guests without payment of any fee for such use.
   TEMPORARY SWIMMING POOL: A temporary receptacle of water or an artificial pool of water with a maximum depth of over eighteen inches (18") with any equipment for water filtration, pumping or water treatment, which is used or intended to be used for swimming by the owner or lessee thereof and family and guests without payment of any fee for such use, and is not intended to be emptied daily.
