8-3-3: LICENSE AND PERMIT REQUIREMENTS:
   A.   License and Permit Required:
      1.   No person shall establish, maintain, conduct or operate a mobile home park after the effective date hereof without first obtaining a license therefor from the Village. Such a license shall be issued for one year and shall expire at twelve o'clock (12:00) midnight on December 31 of each year. The license shall be renewed from year to year upon payment of the annual license fee herein provided. Licenses shall be issued by the Chief Building Official.
      2.   No person shall construct a mobile home park without first obtaining a permit from the Chief Building Official.
      3.   Each mobile home park permit holder shall secure an annual license on or before December 31 following the date on which the construction permit is issued. Application for the annual license shall be made on forms supplied by the Chief Building Official or, if no such forms are available, may be made by letter containing all of the matters required by this Chapter.
   B.   Application for Permit or License: In order to obtain a permit to construct or an original license to operate a mobile home park, the applicant shall file with the Chief Building Official a written application on a form setting forth:
      1.   The full name and address of the applicant or applicants or names and addresses of the partners if the applicant is a partnership, of the names and addresses of the officers if the applicant is a corporation and the present or last occupation of the applicant at the time of the filing of the application.
      2.   The location and legal description of the tract of land upon which it is proposed to operate and maintain a mobile home park.
      3.   The proposed and existing facilities in the park for water supply, sewage, garbage and solid waste disposal and fire protection.
      4.   The proposed method of lighting structures and land upon which the park is located.
      5.   The plat plans of the park drawn on a scale of one hundred feet to one inch (1" = 100'), building plans and specifications for existing buildings and facilities and specifications for new buildings and facilities or the proposed alterations in existing facilities, all showing compliance with the provisions of this chapter, the plat plans to be drawn on a scale of one hundred feet to one inch (1" = 100'), and shall contain, among other things, the following:
         a.   The date on which such plat plans were prepared.
         b.   An arrow indicating north.
         c.   All mobile home lots shall be properly numbered on plat plans.
         d.   Complete information regarding storm sewers.
         e.   Stormwater runoff shall be shown on a separate plat.
         f.   Contour lines at two foot (2') intervals shall be shown on a separate plat and United States Geological Survey data shall be used for the preparation of such plat.
         g.   Grades of driveways and all ditches shall be shown on a separate plat.
         h.   All maps and plans must be signed by and bear the seal of a registered professional engineer.
      6.   A statement of the firefighting facilities, public or private, which are available to the mobile home park.
An affidavit as to the truth of the matters contained in the application shall be attached thereto. Where a permit to construct as well as an original license to operate is sought by the applicant, request therefor shall be made in the same application. Each application for a permit to construct or for an original license shall be made in the same application and shall be accompanied by an application fee and shall be paid to the Village in the amount of the application fee.
   C.   Investigation Of Applicants; Approval Or Disapproval Of License Or Permit; Issuance:
      1.   The Chief Building Official shall examine the application for a permit to construct or an application for a license to operate and maintain a mobile home park, and the Chief Building Official shall, if the park is, or the proposed mobile home park will be, in conformity with this chapter, Title 10 of this Code (Zoning Ordinance) and other applicable ordinances as determined by the Chief Building Official, issue a permit to construct or an original license, as the case may be.
      2.   If the application for a permit to construct or a license to operate and maintain is declined, the Chief Building Official shall give the reasons therefor, in writing, to the applicant, and if the deficiencies can be corrected, the applicant may amend his application and resubmit it for approval.
      3.   If a permit to construct a mobile home park has been issued, the applicant shall, upon completion thereof, notify the Chief Building Official. The Chief Building Official shall then inspect the mobile home park, and if completion is in accordance with the accepted application, the Chief Building Official shall issue a license to operate and maintain said mobile home park.
      4.   Such a permit does not relieve the applicant from complying with the Village Zoning Ordinance, Building Codes 1 and the sewerage treatment and disposal provisions of the Village and other applicable bodies. No mobile home park permit shall be issued if such mobile home park is in violation of the Zoning Ordinance.
      5.   A permit to construct or a license to operate and maintain or the yearly renewal of a license to operate and maintain such mobile home park shall not be issued by the Chief Building Official until evidence exists to demonstrate adequate facilities and services that pertain to the disposal of sewage, water supply and system, garbage and solid waste storage and final disposal and any other health related facilities or conditions at the mobile home park site.
   D.   License Fees: In addition to the application fee provided for herein, the licensee shall pay the Village on or before January 1 of each year an annual license fee, which shall be as follows:
For mobile home parks with:
 
1 to 10 lots
$150.00 plus $10.00 a lot
11 to 50 lots
$250.00 plus $10.00 a lot
51 to 100 lots
$500.00 plus $10.00 a lot
101 to 500 lots
$750.00 plus $10.00 a lot
501 to 1,000 lots
$1,000.00 plus $10.00 a lot
 
Each license for a mobile home park shall be paid to the Village in the amount of the license fee, and any license fee or any part thereof, once paid to and accepted by the Village, shall not be refundable.
   E.   Construction Alterations And Modifications:
      1.   In the event the licensee of a mobile home park wishes to add on or change whatsoever in the mobile home park as covered by the construction permit or license, a new application for construction permit is required. This application shall be accompanied by a fee of two hundred dollars ($200.00) for each mobile home lot. This fee is not refundable.
      2.   The Chief Building Official shall not issue a construction permit to make any alterations, modifications, add ons or changes whatsoever in the mobile home park if the issuance would violate this chapter, the Zoning Ordinance, or other applicable ordinances.
   F.   Conditions of Licenses and Permits:
      1.   Display of License or Permit: Each permit to construct, each license to operate and each permit to make alterations therein shall be prominently displayed in the office of the mobile home park for which the same was issued.
      2.   Separate Permit and License for Each Location: Each permit or license shall apply only to the premises described in the application and in the license issued thereon, and only one location shall be so described in each license.
      3.   Nontransferability of License: A license which has been issued to a person may not be transferred without the written consent of the Chief Building Official. However, the Chief Building Official may not withhold such consent where the provisions of this Chapter have been met. A license which has been issued for a particular premises may not be removed or made to apply to any other premises. (Ord. 93-725, 12-14-93; amd. Ord. 20-1982, 8-25-2020)
