7-1-2: CULVERT CONSTRUCTION:
   A.   Permits Required; Expiration: Before commencing with the erection, enlargement, alteration, construction, repair or removal of any culvert or similar structure or any part or parts thereof in the village, a permit for such erection, enlargement, alteration, construction, repair or removal shall first be obtained by the person desiring to do the same, or his agent, from the village public works supervisor and it shall be unlawful to proceed with such erection, enlargement, alteration, construction, repair or removal unless such permit shall first have been obtained, and if after such permit shall have been granted, the operations called for by said permit shall not be commenced within ninety (90) days after the date thereof or if such operations are not completed within a reasonable time, then such permit shall be void and no operations thereunder shall be commenced or completed until a new permit shall be issued and fees as herein fixed for the original permit shall be paid for such new permit.
   B.   Application For Permit; Fee:
      1.   Application for such permits shall be made by the persons desiring the same, or their agents, to the village public works supervisor. When such application is made, plans and specifications shall be submitted for examination and approval by said village official who shall then issue or cause to be issued a permit and shall file such application.
      2.   The fee for the issuance of each such permit as herein provided for shall be the sum of five dollars ($5.00).
   C.   Agreement To Correct Deficient Work: When such application is made, the applicant shall sign a written agreement with the village to perform all labor and furnish all materials at the applicant's expense as may be required by the village public works supervisor to correct or complete any erection, enlargement, alteration, construction, repair or removal of any culvert not done or existing in reasonable compliance with the application at the time of any inspection of the same as provided for in this section, which agreement shall remain in full force and effect until and unless the work performed pursuant to the permit is accepted on behalf of the village at the final inspection thereof provided for in subsection E of this section, and the applicant shall so correct or complete such work within sixty (60) days after notification that the same is in need of correction or completion. The applicant, in said written agreement, shall further grant to the village the power, right and authority to do or cause to be done the required correction or completion in the event the applicant shall fail to correct or complete the same within said sixty (60) day period, all at the applicant's expense, and the applicant shall, upon notification of the expense of the same, immediately remit the same to the village.
   D.   Requirements And Specifications:
      1.   Number Of Culverts: The permits which may be granted hereunder shall be limited to one driveway or entrance culvert for each residential dwelling building or commercial establishment.
      2.   Specifications: The culverts may not exceed twenty four feet (24') in length, must be of at least fourteen (14) gauge galvanized iron and have a diameter of not less than fifteen inches (15"). (Ord. 0-125, 11-10-1970)
      3.   Ends Protected:
         a.   From and after the effective date hereof, all driveway culverts and culverts installed under and across streets, roads and highways shall be protected at the ends thereof with suitable concrete structures which shall conform to the state of Illinois, department of public works and buildings, construction standard nos. 1564 and 2262, true and correct copies of which are attached to ordinance 0-145 on file in the office of the village clerk and made a part hereof by reference.
         b.   The provisions of this section providing for permits for the construction of entrance culverts shall apply to the construction of the concrete structures provided for in this subsection D3. (Ord. 0-145, 2-22-1972; amd. 1994 Code)
   E.   Inspections: The village public works supervisor or his delegate shall make an inspection of the site of the culvert to be erected, enlarged, altered, constructed, repaired or removed prior to the issuance of the permit herein provided for and shall make such additional inspections as may be necessary and reasonable during the operations for which the permit is issued and shall make a further inspection of the same after the erection, enlargement, alteration, construction, repair or removal provided for in the permit shall be completed and shall make a final inspection of the same as near as conveniently possible to one year after the date of the completion of the work for which the permit was issued. In the event that such erection, enlargement, alteration, construction, repair or removal of any culvert is not done in reasonable compliance with the application in a good and workmanlike manner so that the same shall operate properly, the person to whom such permit is issued shall make such alterations as may be required to cause conformance with the application so that the same exists in good operating condition, all as provided for in the written agreement mentioned and set out in subsection C of this section.
   F.   Variations: Any variations from the provisions provided for in this section may be granted only by the Village Board of Trustees upon proper application to it made. (Ord. 0-125, 11-10-1970; amd. 1994 Code)
