5-5-3: POSSESSION OF SMOKING MATERIALS:
   A.   Definitions: For the purposes of this section, the following words and phrases shall have the meanings respectively ascribed to them:
   MINOR: A person who has not yet attained the age of eighteen (18) years of age.
   PERSON: Any individual, firm, partnership, corporation, company, association, joint venture or any employee or agent thereof, employed by, engaged in, or conducting a business.
   SMOKING MATERIALS: Any substance containing either smoking herbs or tobacco leaf or derivatives of tobacco leaf including, but not limited to, cigarettes, cigars, pipe tobacco, loose tobacco, snuff, chewing tobacco or dipping tobacco. (Ord. 01-1033, 1-23-2001)
   B.   Possession By Minors Prohibited: No individual under eighteen (18) years of age shall possess any smoking materials. (Ord. 08-1483, 6-24-2008)
   C.   Penalty: Any person who is found guilty of committing an offense as established and defined in this section shall be subject to a fine not to exceed five hundred dollars ($500.00) unless otherwise specified herein. (Ord. 01-1033, 1-23-2001)
