For the purpose of this chapter, unless otherwise indicated, the following definitions shall apply:
COMMUNICABLE DISEASE: See definition of Infectious Diseases.
GREEN AREA: An open area dedicated to public use as may from time to time be required by the village.
INFECTIOUS DISEASES: Disease caused by living pathogens which have the ability to multiply such as fungi, bacteria, virus or nematodes.
INSECT INFESTATION: Insects present in such numbers as to cause death or major loss to plants.
NONINFECTIOUS DISEASE: Those diseases caused by nonliving disease agents, such as extremes in temperature, water supply, chemicals, transplant and mechanical injuries.
OVERPLANTED SPECIES: Any parkway tree species that exceeds ten percent (10%) of the total public trees inventoried.
PARKING AREA: An open, hard surface area other than a street or public way, intended to be used for the storage of passenger automobiles and/or commercial vehicles.
PARKS: Those areas in or near the village laid out with walks, drives, playgrounds, benches and/or trees which are preserved for public recreation.
PARKWAY: The unpaved strip of land within a road or street right of way.
PESTILENCE: See definition of Insect Infestation.
PRIVATE PROPERTY: All property not otherwise defined as "public property".
PUBLIC PROPERTY: All property, including rights of way and median strips not privately owned; also easements where the village has rights of access.
REMUNERATION: Pay or compensation for a task done.
RIGHT OF WAY: A strip of land occupied or intended to be occupied by a street, crosswalk, utility line, water line, sewer line, storm sewer line or some other special use.
SIDEWALK: That portion of street or crosswalk paved or otherwise surfaced and intended for pedestrian use only.
STREET: An area which primarily serves or is intended to serve as a vehicular and pedestrian access to abutting lands or to other streets. The word "street" refers to the width of the street right of way or easement, whether public or private and shall not be considered as the width of the roadway or paving or other improvement on the street right of way. Such is to include, but not be limited to, that which is named or commonly referred to as a street, avenue, road, court, boulevard or way.
TOPPING: The severe cutting back of limbs to stubs within the tree's crown to such a degree so as to remove the normal canopy and disfigure the tree.
TREES, SHRUBS OR PLANTS: All vegetation, woody or otherwise, except lawn grass and flowers less than twenty four inches (24") in height. (Ord. 15-1767, 2-10-2015)
