ORDINANCE NO. 19-1450
AN ORDINANCE GRANTING A CONDITIONAL USE FOR AN AUTOMOBILE REPAIR FACILITY AT 303 AMENDODGE, UNITS C&D IN THE VILLAGE OF SHOREWOOD, WILL COUNTY, ILLINOIS
(Diesel Truck Center)

   WHEREAS, the Petitioner in Petition #19-389 is Christopher Flores who owns Diesel Truck Center (“Petitioner”) and the Owner of Record Shoremat Realty LLC (“Owner”) has authorized the Petitioner to act on its behalf regarding the property legally described as:
LOT 9 IN AMENDODGE INDUSTRIAL PARK, A RESUBDIVISION OF PART OF SCHOOL TRUSTEES SUBDIVISION, A SUBDIVISION OF PART OF SECTION 16, TOWNSHIP 35 N, RANGE 9 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED JUNE 2, 1977, AS DOCUMENT NO. R77-18311, IN WILL COUNTY, ILLINOIS.
   Commonly known as 303 Amendodge Drive, Shorewood, IL (PIN 05-06-16-407-010-0000) hereinafter referred to as the “Property”; and
   WHEREAS, the Planning and Zoning Commission of the Village of Shorewood conducted a public hearing on such request as required by law on November 6, 2019  for Petition #19-389 and has adopted the Findings of Fact as presented in the staff memo dated October 30, 2019 and has forwarded its recommendation to the President and Board of Trustees; and
   WHEREAS, the Planning & Zoning Commission recommended approval of the requested Conditional Use, with six votes in favor and none opposed, as hereafter set forth; and
   WHEREAS, it is hereby found and determined by the President and Board of Trustees:
   A.   The Conditional Use will not be detrimental to or endanger the public health, safety and general welfare; and
   B.   The Conditional Use will not be injurious to the use and enjoyment of either property in the immediate area for the purposes already permitted, nor substantially diminish or impair property values within the neighborhood; and
The establishment of the Conditional Use will not impede the normal and orderly development and improvement of adjacent property for uses permitted in the district; and   
   WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the Conditional Use for the Property under the terms and conditions herein set forth, will enable the Village to control the development of the area and will serve the best interests of the Village.
   NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF SHOREWOOD, WILL COUNTY, ILLINOIS, as follows:
SECTION 1:      INCORPORATION OF PREAMBLE AND EXHIBITS
   That the Preamble and all Exhibits to this Ordinance are incorporated herein as if fully set forth in this Section 1.
SECTION 2:      GRANT OF CONDITIONAL USE
   That a Conditional Use is hereby granted for the Property to permit operation of an Automobile Repair Facility, including the repair of tractors (trucks) in the I-2, General Industrial, Zoning District subject to the following conditions:
The business may not utilize the parking gravel yard on the west side of the building, labeled as Potential Truck Parking Area on Exhibit A attached hereto, unless approved by the Village Board.
The property shall be developed, utilized, and all businesses operated in conformance with the Zoning Ordinance and all other applicable ordinances and regulations of the Village.
SECTION 3:      SUCCESSORS
   This Ordinance shall be binding upon and in full force and effect with regard to any successors in interest to the Owner.  Any such successor shall benefit from and be obligated to comply with all of the terms, requirements, limitations, and conditions set forth in this Ordinance as to any portion of the Development owned by it or in which it has any interest.
SECTION 4:      SEVERABILITY 
   In the event any word, phrase, clause, sentence, paragraph, provision or section of this ordinance, or any part thereof, shall be held to be unconstitutional, unenforceable or void, the same shall not affect the validity or enforceability of any remaining words, phrases, clauses, sentences, paragraphs, provisions or sections of this ordinance.
SECTION 5:      REPEALER 
   All ordinances or parts thereof which conflict with any term, condition, provision or section of this Ordinance be and the same are hereby repealed.
SECTION 6:      EFFECTIVE DATE 
   This Ordinance shall be effective after its passage, approval and publication in pamphlet form as provided by law.
