§ 115.04 CONFISCATION OF DEVICES AND MONEY USED IN VIOLATION.
   Any device set out and described under § 115.01 or all articles used in connection with the carrying out of violation of § 115.01, together with all money used in conjunction therewith, may be seized by any peace officer or police officer of this city, with or without a warrant. Upon conviction of the person setting up or keeping the pinball machine, shooting device, target device, amusement device, or contrivance, the money or other articles shall be forfeited for the use of the city or state and the machine or contrivance and other articles shall be burned or destroyed. If the person in violation of this chapter is not convicted as the operator, owner, or the like of the machine or contrivance, but the jury in summary proceedings finds that the money, machine, contrivance, or other article was used or intended to be used for the purpose of gambling, such item or items shall be condemned and forfeited.
