§ 33.03  SANITARY BOARD.
   (A)   Established. There is hereby created a Sanitary Board for the city.

   (B)   Terms; vacancies. The appointment of the original Board shall be for the term of two and three years respectively, and upon the expiration of each term, and each succeeding term thereafter, the appointment of a successor shall be made in like manner for a term of three years. Vacancies shall be filled for the unexpired term in the same manner as the original appointment. The Mayor or City Manager’s term shall not extend beyond his or her tenure of office.

   (C)   Powers; scope; authority. The Sanitary Board shall have the control over and supervision of the construction, acquisition, improvement, equipment, custody, operation and maintenance of a sewage collection system and sewage treatment plant or plants; intercepting sewers; outfall sewers; force mains; pumping stations; ejector stations, the collection and treatment, purification and disposal, in a sanitary manner, of liquid and solid waste, night soil and industrial waste of the city; and, in addition thereto, such Board shall be vested with and shall exercise all of the rights and perform all of the duties conferred upon it by W.Va. Art. 16-11 and 16-13 and all acts amendatory and supplemental thereto.

   (D)   Officers. The Mayor or City Manager shall act as Chair of the Sanitary Board, which shall select from its members a Vice-Chair and shall designate a Secretary and Treasurer, but the Secretary and Treasurer may be one and the same, who need not be a member or members of the Sanitary Board. The Vice-Chair, Secretary and Treasurer shall hold office at the will of the Sanitary Board. The members of the Sanitary Board shall receive compensation for their services, either as salary or as payments for meetings attended, as Council may determine, and shall be entitled to payment for reasonable expenses incurred in the performance of their duties. Council shall fix the reasonable compensation of the Secretary and Treasurer in its discretion, and shall fix the amounts of bond to be given by the Treasurer.
