For entities that receive water at a bulk meter or meters and then distribute to individual homes, the fee shall be the same as a residential service. However, the $2.84 for one and one-half inch meter and above shall not be assessed in this case.

   (B)   Development Code.
      (1)   Any person who is convicted of a violation of the Development Code shall be fined not less than $25, nor more than $500, plus costs. Each day that a violation continues shall be considered a separate offense.
      (2)   All fees shall be paid to the village staff at such time that the request form is properly completed and returned by the applicant. The fees are intended to defray the administrative costs related to the filing and review of the application and inspections and do not constitute a tax or other revenue-raising device. All fees shall be paid to the village staff prior to beginning construction. Failure to pay fees before beginning construction shall subject applicant to a late filing fee charge of 100% of the building permit fee.
         (a)   Code permits and procedures generally. A fee for plat examinations, construction/building permits, special inspections and the like shall be paid to the village staff at a rate or rates recommended by the Planning Commission and approved by the Board of Trustees. These rates shall be updated as required. Current rates are listed below.
            1.   For the purpose of this fee schedule, residential (RES) shall be defined as a one or two dwelling unit structure.
            2.   The (RES) rates shall also apply to accessory uses for the above defined structures.

         (d)   Sewer rates inaction.
            1.   Appendix #1C, Contributions for Green Space, Park, Playgrounds or Other Public Purposes.
               a.   This appendix shall not apply to any development or subdivision for which there is an ordinance approving the preliminary plat or improvement plans, by the village, as of 4-3-2006.
               b.   To be considered as being “active green space”, the following minimum contiguous outlot size must be:
                  i.   To be considered mini park: one acre;
                  ii.   To be considered a neighborhood park: three to ten acres; and
                  iii.   To be considered a community wide park: 30 to 50 acres.
               c.   For single-family districts (NU, CE, R-1, R-2, R-3), the breakdown of required active green space shall be no less than:
                  i.   Mini park: 62 square feet per dwelling unit;
                  ii.   Neighborhood park: 185 square feet per dwelling unit; and
                  iii.   Community wide park: 494 square feet per dwelling unit.
               d.   For MR Districts, the breakdown of required active green space shall be no less than:
                  i.   Mini park: 241 square feet per dwelling unit;
                  ii.   Neighborhood park: 754 square feet per dwelling unit; and
                  iii.   Community wide park: 2,022 square feet per dwelling unit.
               e.   For MH Districts, the breakdown of required active green space shall be no less than:
                  i.   Mini park: 58 square feet per dwelling unit;
                  ii.   Neighborhood park: 180 square feet per dwelling unit; and
                  iii.   Community Wide Park: 483 square feet per dwelling unit.
               f.   In lieu of providing the required amount of active green space per classification listed above, the developer may contribute the following to the village’s park improvement funds:
                  i.   (A)   In NU, CE, R-1, R-2 and R-3 Zone Districts, for every acre of the required classification of active green space not provided the developer’s contribution of $51,000.00 per acre or proportional amount thereof.
                     (B)   As an example, for a 100-unit single-family development, if the mini park and neighborhood park amount is provided, but the developer chooses not to incorporate the community wide park space the developer contribution would be:
100 Homes x 494 square feet per home ÷ 43,560 square feet per acre x $51,000.00 per acre or $57,838.00
                     (C)   The same type of calculation would apply to MR and MH with the associated square foot per unit requirements.
                  ii.   In B-1, B-2, B-3, B-4, PB and I-1 Districts the developer must comply with § 151.302. For every acre or portion of an acre still needed to meet the 8% green space requirement, the developer may elect to contribute $51,000.00 for every acre or prorated portion of an acre.
