§ 130.12 TOBACCO USE IN MOTOR VEHICLES CARRYING INFANTS.
   (A)   The City Council does ordain that is it unlawful for an individual to use tobacco products with a residue of smoke in a motor vehicle occupied by infants (under 18 years of age) within the corporate boundaries of the city limits.
   (B)   As used in this section, the term of RESIDUE OF SMOKE is defined as the air-borne residue of a lighted cigarette, cigar, pipe, weed, plant, regulated narcotic or controlled substance.
   (C)   A law enforcement officer may only utilize the provisions of this section in connection with the observance of the law enforcement officer by any one of the five senses of another criminal offense.
