§ 70.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   Any person who violates the provisions of §§ 70.01 through 70.05 of this chapter shall be subject to a civil fine of not less than $75 for each offense except as hereafter set out. In addition to the above fine provision, the vehicle constituting the violation may be removed. The civil fine for illegal parking in a designated fire lane or designated handicapped parking area shall be the sum of $350.
      (2)   Any individual in receipt of a civil penalty citation may appeal the assessment of the civil fine by filing a written protest with the City Clerk with seven days of the issuance of the citation. Said protest shall be delivered by certified mail to the City Clerk at City Hall, 634 Conestoga Parkway, Shepherdsville, Kentucky 40165. Said protest shall be considered by the Code Enforcement Board at a regular scheduled city business meeting within 45 days of the filing of the protest. The individual who has filed the protest shall have opportunity to contest the civil citation and may present sworn testimony to support the protest. The decision of the Code Enforcement Board to uphold or deny the protest is final. Payment of the civil penalty is due upon the denial of the protest. Any individual who fails to protest the issuance of the citation with seven days of its issuance shall be required to make payment of the civil citation within 14 days of its issuance to the City Clerk, City Hall, 634 Conestoga Parkway, Shepherdsville, Kentucky 40165.
      (3)   Any individual who has failed to pay the civil citation when due shall be guilty of a violation and shall receive a civil fine of not less than $150, and no more than $600, upon conviction.
      (4)   Any individual who feels aggrieved by any decision of the Code Enforcement Board shall have the right to appeal the decision to District Court in the county and avail himself or herself of any judicial remedy allowed by law.
   (C)   The operator of an unlawfully parked vehicle, per § 70.06 of this chapter, may, within 72 hours of the violation, pay to the city $2.50 if the motor vehicle was parked on a meter or a no-parking zone and $5 if the motor vehicle was parked in a fire lane. After the expiration of the 72 hours, the payment of the fine for a metered space or a non-parking zone shall escalate to $5 and the payment for a fine for a motor vehicle within a fire lane shall escalate to $10. If the fine is not paid, as stated herein, any person who violates any of the provisions of § 70.06 of this chapter shall be fined, upon conviction in the District Court, not less than $10, nor more than $100, or imprisoned for not longer than five days, or both.

   (D)   Any person who violates the provisions of § 70.07 of this chapter shall be fined not less than $20, nor more than $2,000, or imprisoned in the County Jail for not more than one year, or both.
