12-8-10: DRAINAGE FACILITIES:
   A.   Approval Required: The drainage system and facilities required for any surface runoff affecting the subdivision are subject to approval by the governing body. Subdivisions containing lots less than twenty (20) acres in size must also be reviewed and approved under Montana Code Annotated title 76, chapter 4, by the DEQ.
   B.   Grading And Drainage Plan: A grading and drainage plan as required by subsection 12-3-5F of this title is subject to approval by the public works director or road department superintendent.
   C.   Curbs And Gutters Or Swales: Curbs and gutters or swales will be required based on the character of the area, density of development, and nature of adjoining properties. Curbs and gutters of adjoining properties must be extended in conformance with current specifications of local and state authorities.
   D.   Culverts And Bridges: Culverts and bridges of adequate size must be provided and installed by the subdivider where drainage channels intersect any street or road right of way or easement. All culverts and bridges must be constructed and installed according to applicable local and state standards. Culverts and other drainage facilities must be large enough to accommodate potential runoff from upstream drainage areas.
   E.   Suitable Drainage Facilities: The subdivider must provide suitable drainage facilities for any surface runoff affecting the subdivision. These facilities must be located in street rights of way or in perpetual easements of appropriate widths.
   F.   Discharge Into Sanitary Sewer Prohibited: Drainage systems must not discharge into any sanitary sewer facility.
   G.   Certification By Professional Engineer: Drainage systems must be designed and certified by a professional engineer.
   H.   Easements: The governing body may require the subdivider to grant easements to prevent encroachment or disruption of drainageways or facilities. Drainage easements must be shown on the plat and a signed statement granting the easements must appear on the plat. (Ord. 784, 8-6-2007)
