For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(a) "Fence." A predominantly vertical and continuous structure or device intended to enclose, confine or delineate an otherwise open area of land. Hedges, trees, bushes, shrubs and plants or ornamental fences are not included within the meaning of the word "fence," but are subject to the regulations of § 1462.06.
(b) "Ornamental fence." A predominantly vertical and continuous structure or device intended primarily for ornamentation and not for confining an area and generally referred to as a "split rail" or "post and rail" fence, or a fence located not closer to any public right-of-way than three feet and constructed in a manner so as to conform to the following:
(1) The maximum height of the fence, from the ground surface along which the fence is erected to the top of the highest rail, shall be 36 inches, and to the top of any post, 42 inches.
(2) No rail, which, for purposes of this division, means a horizontal structure erected as a component part of a fence, shall be constructed nearer to any other rail than six inches, unless the rails criss-cross.
(3) No more than two rails, not to exceed eight inches each in width, shall be constructed between adjacent posts.
(4) No post, which, for purposes of this division, shall be constructed to be a vertical structure erected as a component part of a fence, shall be constructed nearer to any other post than four feet.
(c) "Side yard portion of a front yard." All land adjacent to a front yard and extending backward to the front setback of any dwelling.
(d) "Side yard portion of a rear yard." All land adjacent to a rear yard and extending forward to a point at the front setback of any dwelling.
