§ 238.04 AUXILIARY POLICE UNIT.
   (a)   Pursuant to R.C. § 737.051, an Auxiliary Police Unit is hereby established within the Police Department.
   (b)   The Mayor, as Director of Public Safety, shall be the executive head of the Auxiliary Police Unit and shall make all appointments and removals of auxiliary police officers, subject to any general rules prescribed by Council by ordinance, and shall prescribe rules for the organization, training, administration, control and conduct of the Auxiliary Police Unit.
   (c)   Members of the Auxiliary Police Unit shall not be in the classified service of the city.
   (d)   The maximum authorized personnel strength of the Auxiliary Police Unit shall be 20 officers.
   (e)   Members of the Auxiliary Police Unit who have a current Ohio peace officer certification and who have reached the age of 21 shall be paid the wages of a probationary police officer, as established in the then current collective bargaining agreement for their services, and non-certified officers shall be paid at the then current hourly minimum wage rate as established by the State of Ohio for their services, and the city shall furnish patches and badges for the Auxiliary Police Unit.
   (f)   Members of the Auxiliary Police Unit shall possess the same qualifications required of regular full-time police officers, except that the training may be waived for such period of time as the appointing authority may prescribe.
   (g)   Upon administration of a proper oath of office, each auxiliary police officer shall:
      (1)   Remain on call, as an off-duty police officer, for augmentation of the regular police force at such times and under such conditions as the Director of Public Safety and/or the Chief of Police may, from time to time, deem necessary and proper to provide for the preservation of the health, safety and welfare of persons and their property;
      (2)   Report for active duty as required by the Chief of Police; and
      (3)   Shall not be assigned to enforcement of criminal laws (general crowd and traffic control excepted) or wear or employ firearms in connection with assigned duties until properly trained and qualified in accordance with the laws and regulations made and provided for officers serving in the regular police force.
   (h)   The limitations on assignment of auxiliary police officers under division (g)(3) of this section shall not be construed as a limitation upon the full police power conferred by the city upon all of its police officers, and a violation of that division shall not constitute a defense against the city in any proceedings to enforce criminal laws.
   (i)   Auxiliary police officers shall comply with and be subject to all laws, rules and regulations provided for full-time police officers and to the Auxiliary bylaws, except for those which are inconsistent with the provisions of this section.
   (j) The Chief of Police, with approval of the Mayor, may allow retirees to maintain a commission with the Shelby Police Department, without counting toward the authorized personnel strength of the Auxiliary Unit pursuant to division (d), above. Such officers will maintain police powers but may not be called upon to act in a uniformed enforcement capacity within the Police Department. They may be called upon to perform other voluntary administrative or community service duties, as requested and/or authorized by the Chief of Police.
