§ 51.999  PENALTY.
   (A)   Any person violating any provision of this chapter for which no other penalty is provided shall be fined in an amount not exceeding $500 for each violation.
   (B)   Any person who shall continue any violation of §§ 51.055 through 51.061 or § 51.080 beyond the limits provided in § 51.065 shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not exceeding $500 for each violation.  Each day in which any violation shall continue shall be deemed a separate offense.
   (C)   (1)   Any person, firm or corporation violating any provisions of § 51.057 shall be subject to a civil penalty of $5,000 per day plus costs outlined in divisions (C)(2) and (3) of this section, as set forth in the Fats, Oil and Grease (FOG) Enforcement Matrix.
         (a)   A citation for the civil penalty shall be issued by the Sharpsburg Police Department.
         (b)   Each citation for a civil penalty must be paid within a specified number of days after issuance.
         (c)   Each and every day that the violation continues in violation of any provision of the fats, oil and grease control ordinance, codified in § 51.057, shall be a separate and distinct offense.
      (2)   In addition to the enforcement matrix the violator shall be responsible for the reimbursement to the Town of Sharpsburg of all expenses that the town incurs due to the violation. These expenses include but are not limited to equipment cost, material cost, labor cost, for site remediation and cost recovery of a sanitary sewer overflow.
      (3)   The violator of shall also be responsible for all costs associated with a public or private penalty against the town due to any fats, oils, and grease ordinance violation.
