1040.04 USE OF STREET GUTTERS AND STORM SEWERS FOR SURFACE OR ROOF WATER.
   All surface or roof water provided for in Section 1040.03 shall be continued to and emptied into the street gutter or into storm sewers on those streets having the same. The construction for the care of such water shall be suitable pipe or pipes layed under the sidewalk and through the curb, where possible, and in all cases shall be of such type as is approved by the Code Enforcement Officer. Where no curb is in place, the outlet shall be into the existing street ditch or gutter at such place and at such elevation as are approved by the Code Enforcement Officer. When there exists adequate slope and suitable runoff area to allow safe aboveground discharge of roof drainage such that no resulting hazard or property damage will occur, the use of either energy absorbing splash blocks or an overflowing, gravel-filled drainage sump that discharges to an appropriate green area may be approved at the direction of the Code Enforcement Officer. The cost of construction and maintenance of the conduit for such water shall be borne entirely by the property owner.
