(A) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
COVERED or CLOSED CHANNELS. Any ditch or system of pipe or tile intended to control the flow of wastewater, sewerage or oil and which is constructed and maintained in such a manner so as not to permit the escape or leakage of the wastewater, sewerage or oil or the noxious odors arising there from.
DITCHES, STREAMS, and BRANCHES. All open or covered channels, whether natural or humanmade, which control or are intended to control the flow of water.
OIL. All types of lubricating oil; shall also include kerosene and gasoline.
WASTEWATER. Any water that has been used for residential or commercial use and any water which contains elements or materials not found in the water in its raw state.
(B) There is hereby created the position of Sanitary Inspector for the town and he or she is hereby vested with all the powers and charged with all the duties imposed upon him or her by state law.
(C) No person shall deposit, cause to be deposited or permit the deposit of wastewateror sewerage upon the surface of the ground or in any storm sewers, ditches, streams, branches or rivers within the town. However, wastewater, sewerage and oil may be deposited in covered or closed channels which empty into a sanitary disposal system as required by state law.
(D) It shall be unlawful and shall constitute a nuisance for any person to allow or permit house offal, dead animals, refuse, decayed flesh, other decayed matters or any other thing which may tend to affect injuriously the health of any citizen to remain on his or her property or property occupied by him or her.
(E) The Sanitary Inspector shall notify any person who is in violation of the provisions of this section and shall direct the person to remedy or remove the same. If the violation is not remedied within ten days after notice thereof, the Sanitary Inspector shall remove, remedy or abate the same and the expense of the action shall be paid by the person in default, and, if not paid, shall be a lien upon the land or premises where the violation occurred and shall be collected as unpaid taxes.
