153.04 SUPERVISION OF WORK; DEPOSITS AND FEES FOR INSPECTIONS AND RESTORATION; GENERAL REQUIREMENTS.
   (a)   The Director of Public Works shall supervise all work performed under the provisions of this Chapter. The work shall be performed according to the specifications concerning such work which have been established by and are on file in the office of the Director. The Director or the Director's designee shall make such inspections of the work as the Director or designee may deem necessary. The fee for each inspection shall be as set forth in this Section and the total charge for such inspections shall be deducted from the cash deposit before the balance is returned to the applicant. If the City is required to perform any work for the applicant for the protection or preservation of the public property, the cost of the work shall be deducted from the cash deposit.
   (b)   Deposits and Inspection Fees:
      (1)   Obstructing or Disturbing Public Property. If work under a Public Property General or Construction permit issued pursuant to this Chapter requires obstructing and/or disturbing Public Property, as defined in this Section:
         A.   A single deposit shall be required as set forth in sub-section 153.02(a). The deposit is subject to increase if the nature of the work warrants, or if damage during construction exceeds the deposit.
         B.   The City may deduct from the deposit a fee of $30.00 for two regular inspections.
         C.   The City may deduct from the deposit a fee of $15.00 for each additional inspection requested by the person or entity to whom the permit was issued, or if further inspections are made necessary by incomplete or disapproved work.
         D.   The Director may require a deposit of $200.00 for the hauling of excavated material over City streets.   
      (2)   Curb Cutting Fees. If work under a permit issued pursuant to this Chapter requires the cutting and removal of curbing along City streets, in addition to the Permit Fee required in this Chapter, and the deposit required as set forth in sub-section 153.02(a), inspection fees shall be deducted from the deposit, as follows:
         A.   Per foot: $2.00
         B.   Minimum: $20.00
         C.   Minimum for widening: $10.00.
Note: new curb cuts must be approved by the Department of Planning prior to a permit being issued that includes any new curb cut as a part of the work.
   (c)   For the purposes of this Chapter, the following terms shall be defined as follows:
      (1)   "Disturbing" shall mean to excavate, dig into, scrape, cut, saw, break, drill into, bore under, drain, or otherwise alter or move either temporarily or permanently, any part of Public Property, including, without limitation, the existing surface or subsurface structure, composition, physical facilities of any third party, landscaping, or soil compaction, for the purpose of carrying on any work activity.
      (2)   "Obstructing" shall mean to block or divert any lawful vehicular, bicycle, and/or pedestrian traffic, use and/or parking from Public Property for the purpose of conducting work.
   (d)   Other Permits. No person or entity may conduct any work on Public Property covered by this Chapter without having first obtained any permits and/or approvals required by the City's Building Code, or any other Ordinance of the City. Such requirements shall be in addition to the required General or Construction Permit.
      
   (e)   The Director of Public Works or the Director's designee may issue a stop work order if any inspection finds that the work, or any part of the work, does not comply with the General or Construction Permit, the approved plans and specifications for the work, or the requirements of this Chapter and any other permit issued for the work by the City. If such an order is issued, all work, or the designated work, shall immediately cease and shall be immediately removed and/or corrected by the party to whom the Permit was issued, or their contractor or agent.
      (f)    Upon completion of the work authorized under the General or Construction Permit, the permit holder and/or their contractor or agent shall promptly repair and/or restore any and all Public Property, and any public or private facilities or infrastructure in, on, or under the Public Property impacted by the work, restoring the same as nearly as practicable to its condition before the start of the work.
