(a) A church or other religious worship hall is a permissible use in all use districts in the City.
(b) Notwithstanding anything to the contrary in Subsection 7 (a) of Article XII of this Charter, before a church or other religious worship hall may locate, operate, or be maintained on a parcel or property zoned primarily for single family residential use, the use of said parcel of property for the location, maintenance, or operation of a church or other religious worship hall must be approved by a majority of the electors of this Municipality voting thereon.
(c) Upon approval, as required by this Section 7 of Article XII of this Charter, of the location, operation, or maintenance of a church or other religious worship hall on a parcel of property zoned primarily for single family residential use, a church or other religious worship hall may locate, operate, or be maintained thereat after compliance with all applicable regulatory ordinances of the City.
(d) A person desiring to locate, operate, or maintain a church or other religious worship hall on a parcel of property zoned primarily for single family residential use must file with the Clerk of Council a request that the proposed use of the property for the location, operation, or maintenance of a church or other religious worship hall be submitted to a vote of the electors of this Municipality.
(e) A request that a church or other religious worship hall be located, operated, or maintained on a parcel of property zoned primarily for single family residential use shall be submitted to the electors at the next regularly scheduled election, occurring not less than sixty (60) nor more than one hundred twenty (120) days from the date the request was filed with the Clerk of Council. If a regularly scheduled election does not occur more than sixty (60) days and less than one hundred twenty (120) days from the date the request was filed with the Clerk of Council, then the request shall be submitted to the electors at a special election held on a date to be determined by the City Council but not less than sixty (60) nor more than one hundred twenty (120) days from the date the request was filed with the Clerk of Council.
(f) The provisions of this Section 7 of Article XII of this Charter do not apply to the location, operation, or maintenance of a church or other religious worship hall on a parcel of property on which a church or other religious worship hall has been continually located, operated, or maintained since the date of enactment of Section 7 of Article XII of this Charter. For the purposes of this Subsection 7 (f) a church or other religious worship hall is located, operated, or maintained on a parcel of property if it is actually located, operated, or maintained on the parcel of property, or proper application has been made for all necessary building permits to construct a church or other religious worship hall on the parcel of property prior to the date of enactment of this Section 7 of Article XII of this Charter.
