SECTION VIII-2. EFFECTIVE DATE OF ORDINANCES AND RESOLUTIONS.
   Each ordinance or resolution providing for the appropriation of money, or for an annual tax levy, or for improvements petitioned for by the owners of a majority of the foot frontage of the property to be benefitted and specially assessed therefor, and any emergency ordinance or resolution necessary for the immediate preservation of the public peace, health, welfare or safety shall go into immediate effect, unless a later time be specified therein, upon its approval by the Mayor, or upon its passage after disapproval by the Mayor, as the case may be. Such emergency laws upon a yea and nay vote must receive the vote of two-thirds of all the members elected to council, and the reasons for such necessity shall be set forth in one section of the law, which section shall be passed only upon a yea and a nay vote, upon a separate roll call thereon. The laws mentioned in this section shall not be subject to the referendum.
   No action of the council authorizing any change in the boundaries of the City or the surrender or joint exercise of any of its powers or granting, renewing or extending any franchise or other special privileges, or contracting for the supply to the City or its inhabitants of the product or service of any utility, whether city owned or not, or regulating the rate to be charged for its services, shall be designated as an emergency measure. Any ordinance passed in violation of this section or Section 1 of this article shall not become law under any circumstances or upon any date.
   In the event it is proposed to re-zone one or more parcels of land to any use which would permit the erection thereon of one or more multifamily dwellings, the ordinance whereby such use is proposed shall be submitted to the electors for approval at the next regular election - municipal or general - provided said election shall occur not less than ninety (90) days after the request for such land use shall have been received by Council. Such submitted ordinance shall not become effective unless it shall be approved by a majority of electors voting upon said ordinance. (Adopted 11-5-02)
