1134.01 UNLAWFUL EXPOSURE PROHIBITED IN FOOD AND BEVERAGE ESTABLISHMENTS BY EMPLOYEES.
   No person shall, while acting as a server, waiter, waitress, entertainer or employee, in an establishment which serves either food alone, beverages alone, permits the bringing in of food, or beverages, or food and beverages (the term “beverages” as used herein shall include, but shall not be limited to, alcoholic beverages) for consumption on the premises of the establishment; premises shall include businesses which permit the bringing onto premises food and beverages:
   (a)   Expose his or her genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or
   (b)   Expose any device, costume or covering which gives the appearance of or simulates the genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or
   (c)   Expose any portion of the female breast at or below the areola thereof.

1134.02 ASSISTING UNLAWFUL EXPOSURE PROHIBITED.
   No person shall cause, permit, procure, counsel or assist any person to expose or simulate exposure as prohibited in Section 1134.01.

1134.03 DEFINITION OF “EMPLOYEE”.
   A person shall be deemed to be a server, waiter, waitress, entertainer or employee if such person acts in that capacity without regard to whether or not such person is paid any compensation by the owner or management of the establishment in which the activity is performed.
