970.10 OFF-STREET PARKING IN LOCAL AND GENERAL RETAIL BUSINESS DISTRICTS.
   All off-street parking and loading-unloading spaces shall be clearly marked. Any required parking space for a building or use which is provided on adjoining or adjacent premises, where such arrangement is permitted under this chapter, shall be in the form of allocation of not less than the required number of parking spaces for the exclusive use of such building or premises during its normal hours of activity or operation.
   No building shall hereafter be erected nor shall any building be remodeled or altered to provide for a greater degree or intensity of use, and no change shall be made in the use of a building or premises that will increase the parking space needs or loading space needs unless the requirements of this chapter are fulfilled for the off-street garaging or parking of motor vehicles of the occupants, employees, patrons, clients or guests thereof, and for off-street loading and unloading. Adequate street access to parking and loading spaces shall be provided and kept open and unobstructed.
   (a)    Specifications and Plans.
      (1)    Surface and drainage. Driveways and parking spaces shall be smoothly graded and surfaced with either concrete or asphalt, and adequately drained into a storm sewer. Surface waters are not permitted to discharge over or onto public sidewalks or roadways or onto other premises.
      (2)    Lighting. Adequate lighting is to be provided if the parking lot is open after sunset. Light posts shall conform to the design of the building. The lighting is to be reflected away from adjacent residential areas and streets, and is to be so arranged as to cause no annoying glare.
      (3)    Screening. Wherever a parking lot or driveway thereto adjoins a residence district, such parking lot or driveway shall be separated from the residence district by a solid decorative masonry wall or other effective sightly screening, at least six feet high.
      (4)    Setback. Wherever a parking lot abutts a street opposite residential property, there shall be a setback area provided of a minimum of ten feet, which area shall contain grass and shrubbery and a solid decorative masonry wall or other effective sightly screening, at least six feet high. Wherever a parking lot abutts a street opposite office or business property, there shall be a setback area provided of a minimum of five feet, or a decorative masonry wall a minimum of three feet in height. Such setback area, if provided, shall be adequately landscaped.
         Any wall, fence or planting provided in accordance herewith shall be adequately protected from damage by vehicles using the parking lot and shall be properly maintained and kept in good repair at all times.
      (5)    Driveway. The driveway entrance to any parking lot shall be a minimum of twenty feet in width, at the sidewalk, and not more than thirty feet in width, with an adequate flare as approved by the City Engineer. If more than one driveway is provided, the traffic flow to and from the street shall be determined by the City Engineer of the City. No wall, fencing or screening shall interfere with the visibility of traffic entering or exiting the parking lot or using the street adjacent thereto. Appeals from the decision of the City Engineer shall be taken to the Council Safety Committee.
      (6)    Plans. The owner of property desiring to construct a parking lot thereon, shall submit a plan showing the number and size of parking spaces, the size of aisles, the size and number of driveways, the location, style, color, and size of signs, the type of lighting and wiring diagram, the setback and location and type of screening and drainage to the Planning Commission, along with the plans for the building to be erected, prior to the issuance of a building permit.

   (b)    Required Garages and Parking Spaces in Local and General Retail Business Districts. 
      (1)    Theaters; places of public assembly. Each theater and place of public assembly shall have off-street parking space on its premises or within a street distance of 1,000 feet sufficient in capacity for the parking at one time of one automobile per four seats of planned seating capacity of the premises, provided, however, that only such off-street parking space sufficient in capacity for the parking at one time of one automobile per six seats of planned seating capacity shall be required if the Board of Zoning Appeals and Council find that because of the location, purpose and surroundings of the proposed building, such reduced amount of off-street parking space will be adequate.

      (2)    Retail stores and shops. Each building or portion of building containing banks, retail stores or retail shops having a combined floor area in excess of 1,000 square feet shall have a parking lot on or adjoining its premises, sufficient in capacity to provide for the use of such premises one car-parking space for each 175 square feet of gross floor space in the building or such portion thereof. The Board of Zoning Appeals, with the confirmation of Council, may permit either a temporary or permanent variance of the parking space requirements as to basement space, upper floor space, changes in the occupancy of an existing building, alterations or additions to an existing building or the construction of new buildings, if the Board of Zoning Appeals, and Council find that the location, size, use, purpose or surroundings of the land and building require fewer parking spaces, determine the number of parking spaces required to serve the land and building, and find that such characteristics are peculiar to the premises in question and are not shared by other a land or buildings in the immediately vicinity.
      (3)    Medical and dental offices. Each building or portion of building used for the offices of physicians, dentists or others rendering similar services, shall have a parking lot on or adjoining its premises, sufficient in capacity to provide for the use of such premises one car-parking space for each 150 square feet of gross floor space in the building or such portion thereof excepting only unoccupied basement space and space used exclusively for mechanical equipment necessary for the lighting, heating and air conditioning of the building. The Board of Zoning Appeals with the confirmation of Council may permit either a permanent or temporary variance from the parking space requirements of this subsection if it is found that the location, size, use or surroundings of the land and building requires fewer parking spaces and that such characteristics are peculiar to the premises in question.
      (4)    Other premises. Each building or portion of building or use other than those enumerated above in this chapter shall have off-street parking space on or adjoining its premises sufficient in capacity to provide for the use of such premises one car-parking space for each 300 square feet of gross floor space; however, if the Board of Zoning Appeals and Council find that because of the location, purpose and surroundings of the proposed building that a reduced amount of off-street parking space is adequate, then such a reduced amount of off-street parking space may be permitted with the approval of the Board of Zoning Appeals and confirmation of such approval by Council.
