(a) “Heavy earth moving and construction equipment”, as used in this section, means that equipment which the manufacturers thereof have designated to be of such description. (Ord. 45-1965. Passed 9-27-65.)
(b) No person shall operate heavy earth moving and construction equipment in the City between the hours of 6:00 p.m. and 7:30 a.m. Monday through Saturday of each week.

(c) No person shall operate heavy duty earth moving and construction equipment in the City on Sundays and the following legal holidays: New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day, between the hours of 12:01 a.m. and 11:59 p.m.
(d) In the event an emergency situation exists requiring work to be done at a time or day prohibited herein, then upon request of and approval by the Safety-Service Director, such work may be performed at a time or day for which approval is granted therefor.

(e) Whoever violates this section is guilty of a minor misdemeanor.
