(a) After the refusal of the Design Review Board to approve an application, the aggrieved person may make a written appeal to the Board of Appeals, consisting of the Mayor, City Solicitor, City Manager, and Chairperson of the Design Review Board and Planning and Zoning, specifying the grounds for appeal. Such appeal shall be made within twenty days after the decision of the Design Review Board. Upon payment of fee set by Council, the Board of Appeals will review and rule on the applicant.
(b) In the hearing, the applicant has the burden of showing why he is unable to comply with the design review criteria, and to show whatever hardship we would incur by not fulfilling the intent of the Zoning Ordinance. The full record of the hearing shall become a part of the record of the Design Review Board. (Ord. 1676-00. Passed 6-12-00.)
