133.04 PROMOTIONS; VACANCIES; ACTING EMPLOYEES.
   (a)   Promotions. Upon the recommendation of the Chief of Police, the Manager may make in-grade promotions and rank promotions to fill a vacancy.
   (b)   Vacancies; Acting Employees. The Chief of Police may designate any member of the Division of Police who is otherwise qualified, to serve in an acting capacity until such time as a temporarily absent member returns to duty or a vacancy is filled by a replacement duly appointed and confirmed, as the case may be. In the case of a vacancy in the office of Chief of Police, due to the temporary absence of the Chief for any reason, including illness, an acting Chief may be designated by the Chief with the consent of the Manager and Safety Committee of Council. In the event that the Chief fails or is unable to designate an acting Chief as aforesaid; or in the event that there is a permanent vacancy in the office of Chief of Police due to death, resignation, suspension or removal, then in any of these events, the Manager may designate any of the highest ranking officers of equal rank in the Division who is otherwise qualified and with the consent of the Safety Committee of Council to serve as acting Chief until such time as a successor is duly appointed and confirmed according to law. Any such acting employee pursuant to this section shall receive the compensation provided for the position which he is temporarily filling according to the compensation ordinance in effect at that time.
