SECTION 3.01 NUMBER AND TERM.
   The legislative powers of the Municipality, except as otherwise provided by this Charter and by the Constitution of the State of Ohio, shall be vested in a Council of six (6) members, consisting of persons elected from the Municipality at large. All members of the Council shall be elected for overlapping terms of four years. At the Municipal general election to be held in November, 1981, four (4) members of the Council shall be elected to four-year terms of office; and at the Municipal general election to be held in November, 1983, two (2) members of the Council shall be elected to four-year terms of office. Prior to the Municipal general election to be held in November, 1981, the composition of the Council shall be determined in accordance with the transitional provisions contained in Section 12.02 of this Charter.
   Members of Council shall take office January 1st of the year following their election and shall serve until the expiration of their term of office and until their successors are elected and qualified, or appointed and qualified. If for any reason a member of the Council shall fail to qualify for office within forty-five (45) days after January 1st of the year following his election, a vacancy shall be deemed to exist and such vacancy shall be filled in the manner provided in Section 3.14 of this Charter.
