The Model Housing Code adopted in Section 1331.01 is modified by the amendment, enactment or deletion of the following sections as respectively indicated, which modifications are hereby adopted as set forth herein.
(a) Amendments.
(1) Local jurisdiction. At every place in any section or subsection of the Model Housing Code where the phrase "the local jurisdiction" or "the name of the local jurisdiction" is found, such phrases shall be amended to provide "the Municipality of Sebring, Ohio".
(2) Enforcement. At every place in any section or subsection of the Model Housing Code where the term "enforcement agency" or "appropriate authority" is found, such terms shall be amended to provide "the Housing Inspector".
(3) 3.01. The Housing Inspector is hereby authorized, upon presentation of proper credentials, to enter and inspect a dwelling, dwelling unit, rooming house, rooming unit, or dormitory room, and enter onto and inspect the surrounding premises of all dwellings, dwelling units, rooming houses, rooming units and dormitory rooms within the Municipal limits, between the hours of 8:00 a.m. and 8:00 p.m. to determine violation of or compliance with this chapter.
(4) 3.02. The Housing Inspector is hereby authorized to seek a court-issued warrant for inspection, if refused admission to a dwelling upon the third attempt. Each attempt to gain admission shall have been made on separate days within a thirty day period of time between the hours of 8:00 a.m. and 8:00 p.m.
(5) 3.03 b. A plan for the systematic inspection of dwelling units contained in contiguous areas within the Municipality every five years, as designated by the Council.
(6) Order to vacate. Upon declaring any structure unfit for human habitation, the Housing Inspector may immediately order the structure vacated within twenty-four hours; provided, however, that such order to vacate shall be indefinitely stayed if the Housing Inspector finds that the owner has taken steps to remedy the conditions, and that the condition no longer constitutes a serious danger to the life, health, or safety of the occupants of such structure. Any structure vacated pursuant to an order of the Housing Inspector may be placarded and no person shall occupy such structure, until such placard has been removed by an order given by the Housing Inspector.
(7) 8.16.01. Flammable Liquids as defined in the National Fire Prevention Code.
(8) 14.00. The Planning Commission and Board of Zoning Appeals of the Municipality shall serve ex officio as the Housing Appeals Board for purposes of this chapter. The Housing Inspector shall serve ex officio as Executive Secretary of the Housing Appeals Board.
(9) 14.03. The Housing Appeals Board shall adopt rules of procedure not inconsistent with this chapter. No member of the Board shall take part in any hearing or determination in which he has a personal or financial interest. A majority of the Board shall constitute a quorum. The Board shall meet from time to time as determined by the Chairman.
(b) Deletions.
(1) Chapter XI. Registering the Operation of Multiple Dwellings and Rooming Houses (Sections 11.01 to 11.12 inclusive) is deleted in its entirety.
(2) Chapter XV. Creation of the Nuisance Abatement Board (Sections 15.01 to 15.04.06 inclusive) is deleted in its entirety. Nuisance abatement will continue to be regulated by the provisions of Chapter 1341.
(3) Chapter XVII. Citizens' Advisory Mechanism (Section 17.01) is deleted in its entirety.
(4) Section 14.01. This section is deleted in its entirety.
(5) Section 14.02. This section is deleted in its entirety.
