Upon the conviction of any person driving a motor vehicle while under the influence of alcoholic liquor or drugs in violation of the laws of the state or this code, there shall be assessed as part of the court costs, a fee of $75 for breath test administered by a police officer, if administered pursuant to a valid permit, and if such test is actually made.
