§ 22-5-11 CLASSIFICATION OF PENALTIES.
   (A)   For the purposes of this article, violations are divided into the following two classes which are hereby authorized upon conviction:
      (1)   Class V.
         (a)   Maximum: no imprisonment, $100 fine; and
         (b)   Minimum: none.
      (2)   Class W. Driving while intoxicated and implied consent refusal:
         (a)   First conviction.
            1.   Maximum: 60 days imprisonment and $500 fine; and
            2.   Mandatory minimum: seven days imprisonment and $400 fine.
         (b)   Second conviction.
            1.   Maximum: 90 days imprisonment and $500 fine; and
            2.   Mandatory minimum: 30 days imprisonment and $500 fine.
         (c)   Third conviction.
            1.   Maximum: one year imprisonment and $600 fine; and
            2.   Mandatory minimum: 90 days imprisonment and $600 fine.
   (B)   Sentences of imprisonment in Class W violations shall be served in the county jail.
