§ 119.283 AUTOMATIC DRY CLEANING MACHINES.
   (A)   Definition: An “automatic dry cleaning machine”, as used in this Section, shall mean any device or apparatus for the cleaning of clothes or fabrics, designed to be used or operated only by the owner or his employee, which makes use of or contains perchloroethylene or any other chemical solvent or substance which may cause harm to human beings through inhalation or contact.
   (B)   License and Compliance Required: No person shall engage in the business of maintaining any automatic dry cleaning machine for use by the public within the corporate limits of the Village except in compliance with the provisions of this Section. It shall be unlawful to engage in the business of maintaining any automatic dry cleaning machine for use by the public within the Village unless such person has applied for and obtained a license from the Village Clerk as provided in § 119.007 of this Chapter.
   (C)   License Fee:  The fee for a license for an automatic dry cleaning machine for public use shall be as provided in § 119.008 of this Chapter.
   (D)   Construction and Installation Requirements:
      (1)   Generally:  Each automatic dry cleaning machine shall be so designed and constructed as to prevent the leakage of liquids, gases or vapors.
      (2)   Cabinets and Hoods:
         (a)   Each automatic dry cleaning machine shall be completely enclosed by a cabinet and shall be vented with intake at the top and the outlet at or near the bottom of such machine.
         (b)   Groups of machines may be entirely enclosed or supported on all open sides by enclosure topped with a hood vented for each individual machine.
      (3)   Exhaust System: An exhaust system for each automatic dry cleaning machine shall be required. It must maintain a minimum flow of one hundred (100) cubic feet per minute face velocity through the loading door of the machine whenever it is open.
      (4)   Discharge Stack: A discharge stack for both automatic dry cleaning machines for and the room in which they are located shall be required. It shall extend at least two feet (2') above the level of any window which can be opened which is located within fifty feet (50') of the outlet of the stack and shall be at least fifty feet (50') from any fresh air intake leading to any of the premises.
      (5)   Portals and Loading Doors: 
         (a)   Each automatic dry cleaning machine shall be equipped with a transparent door or port to allow visual examination of the status of the cleaning cycle.
         (b)   All such machines shall be so con- structed as to prevent the loading door from being opened during the normal cycle of operation.
      (6)   Water and Sewer Connections:
         (a)   Any connection of an automatic dry cleaning machine with the water supply system must be equipped with an air gap or vacuum breaker in the line upstream from the condenser; no control valves shall be downstream from such gap or breaker.
         (b)   Wastewater shall be discharged through an air gap.
   (E)   Building and Premises Requirements:
      (1)   Ventilation: The rooms in which auto- matic dry cleaning machines are installed shall be ventilated so that, from the area to which the public is admitted, there shall be the following minimum cubic feet per minute airflow requirements per machine:

* For the purpose of this subsection, each cleaning cell shall be considered as one machine.
      (2)   Signs Required:
         (a)   There shall be warning signs posted in premises containing automatic dry cleaning machines in places of easy observation warning of the dangers in the event of leakage of liquids, gases or vapors.
         (b)   Owner's Sign:  At least one legible sign shall be maintained in premises containing automatic dry cleaning machines in a place available to customers giving the name, address and phone number of the owner of the establishment and of the service department or agency responsible for the proper maintenance of the machines.
   (F)   Operation of Machines and Business:
      (1)   Operation of Machines Generally: No automatic dry cleaning machine shall be operated unless all equipment is properly installed and in good operating condition.
      (2)   Attendant Required:  No establishment containing an automatic dry cleaning machine shall be open for business or admit the public or customers into the room where such machines are located unless there is on duty in the establishment at all times a competent person in charge of them.
   (G)   Disposal of Residues: No automatic dry cleaning machine residue-containing solvent shall flow into the Village's sewer system. Tightly covered metal containers may be used for temporary storage of such waste outside the building containing the machines. Such containers shall bear labels indicating the contents and dangers involved in handling and shall be locked if in an unenclosed place.
   (H)   Inspections: It shall be the duty of the Village Manager/Comptroller to cause such inspections to be made as are necessary to see to the enforcement of the provisions of this Section.
