955.11  RECYCLING SERVICES TO BE OFFERED.
   (a)   Subject to the provisions of this chapter, each licensed commercial hauler engaged in the collection of garbage or refuse within the City of Sandusky, Ohio, shall establish a recycling program, and hereafter shall offer to the customers of said licensed commercial hauler recycling services, and, then, and from time to time thereafter as directed by the City Manager each licensed commercial hauler shall provide to said City Manager reasonably adequate proof and documentation of said commercial hauler's full and complete compliance with the provisions of Sections 955.10 through 955.14.
   (b)   As a part of the recycling program of each commercial hauler, and/or the recycling services provided thereby pursuant to this chapter and section, each commercial hauler shall offer to each of the customers thereof the service of collecting and conveying recyclables accumulated by each customer in connection with the occupation or use of said customer within the City of Sandusky. The collection and conveyance of recyclables required hereby shall be offered by each commercial hauler to each customer thereof at such frequency as said commercial hauler collects and conveys the garbage and/or refuse of each customer.
   (c)   At the option of each commercial hauler, the recyclables collected thereby shall be packaged and contained for curbside collection in one or the other of the manners set forth below:
(1)   Placed completely within a bin, can, box, or other container with full and solid sides and bottom made of plastic, or of galvanized or other noncorrosive metal which is suitable for said purpose; which has clearly and legibly marked thereupon the legend "RECYCLABLES"; which are of such size and/or numbers as to be reasonably adequate to contain as to each occasion of collection the recyclables produced by the occupation or use of said customer within the City of Sandusky; or
(2)   Placed completely within solidly secured blue plastic bags of a strength not less than 1.2 mils. and of a material through which in normal daylight conditions the content thereof may be discerned with reasonable certainty by use of the naked eye at a distance of four (4) feet or more;
   (d)   Containers in which recyclables are deposited as part of a curbside collection program or services provided by a commercial hauler shall be used exclusively to contain recyclables, and shall not be used to contain any other solid waste, or any garbage, refuse or other discarded material.
   (e)   Recyclables which are collected by commercial haulers as part of curbside collection programs or services contemplated hereby shall be disposed of by said hauler exclusively for recycling, and shall not be delivered to and/or disposed of at a landfill.
   (f)   Within a period of not more than ninety (90) days after the enactment of this section, the City of Sandusky shall cause notice of said enactment, and a summary of the recycling program and services which are required hereby to be offered to be published once each week for two (2) consecutive weeks in a newspaper of general circulation within the City of Sandusky, Ohio, and shall further cause copies thereof to be delivered to each of the users of the sewer and/or water services of the City which are contained within the municipal limits thereof by enclosing the same within each person's water and/or sewer billing. Thereafter, each commercial hauler within a period of not more than fifteen (15) days after said commercial hauler contracts for or agrees to the provision of services to a person in the collection, conveyance or disposal of garbage, solid waste, refuse, and/or other discarded materials or to the reinitiation of the same, shall provide to each person notice of the content of this section, and a summary of the recycling program which are required hereby to be offered, in such written manner and form as the City Manager deems appropriate. Further, once each year, beginning with the calendar year 1996, and thereafter, each commercial hauler engaged in the collection and removal of garbage, refuse, and/or recyclables shall provide to each of his or her customers during the months of March, April, or May, written notice of the availability and cost of recycling services. As part of the licensing process of commercial haulers under this chapter, on an annual basis, each commercial hauler engaged in the collection and removal of garbage, refuse, and/or recyclables within the City of Sandusky shall provide to the City of Sandusky, Ohio, adequate and appropriate demonstration of his or her compliance for the prior year with the written notice requirements of this section. Failure of any such commercial hauler to comply fully with the notice requirements of this section, or to afford the City demonstration of the same shall be and constitute grounds for the refusal of the issuance of license under this chapter.
