ADOPTING ORDINANCE
ORDINANCE NO. 1050
AN ORDINANCE OF THE CITY OF SANDPOINT, BONNER COUNTY, IDAHO, ADOPTING THE CITY CODE OF SANDPOINT, IDAHO, FOR REVISING, CODIFYING AND COMPILING THE GENERAL ORDINANCES OF THE CITY OF SANDPOINT AS CODIFIED BY STERLING CODIFIERS THROUGH AND INCLUDING CITY OF SANDPOINT ORDINANCE NO. 1044, PROVIDING PENALTIES FOR UNLAWFUL ALTERATION OR MODIFICATION OF THE CODE, AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE.
   Be it ordained by the Mayor and City Council of the City of Sandpoint, as follows, to-wit:
   Whereas, provisions of Title 50, Chapter 9 Idaho Code authorize publication of compiled ordinances of a city by compilation and codification, and
   Whereas, it is sound practice to enact a periodic codification ordinance to establish a baseline for further codification efforts.
   SECTION 1: Ordinance No. 773 adopted the official City Code of the City of Sandpoint, together with a method of perpetual codification by Sterling Codifiers, Inc. on the 22nd day of February, 1983. Subsequent to such adoption, the city council has enacted ordinances through the ordinance number #1044, a summary of which was published on the 2nd day of November, 2000. This ordinance hereby adopts the codification compiled by Sterling Codifiers incorporating all ordinances enacted up to and including Ordinance #1044. By such adoption the City council also confirms, approves and re-enacts all previously adopted ordinance provisions and ordinance summaries of the City of Sandpoint, up to and inclusive of Ordinance #1044, as such have been compiled by Sterling Codifiers. A copy of the compilation existing at the time of approval of this ordinance shall be filed and maintained with this ordinance to serve as a codification reference from the effective date of Ordinance #1044, going forward.
   SECTION 2: The codification completed by Sterling Codifiers through ordinance #1044 enacted on the 18th day of October, 2000, constitutes a compilation of all ordinances of a general nature, together with subsequent changes made to said ordinances, under the direction of the governing body of the City. It shall be accepted in all courts as the official Code and law of the City as enacted by the Mayor and City Council.
   SECTION 3: All ordinances of a general nature included in this official City Code shall be considered as a continuation of said ordinance provision and the fact that some provisions have been deliberately eliminated by the governing body shall not serve to cause any interruption in the continuous effectiveness of ordinances included in said official City Code. All ordinances of a special nature, such as tax levy ordinances, bond ordinances, franchises, vacating ordinances and annexation ordinances shall continue in full force and effect unless specifically repealed or amended by a provision of the City Code. Such ordinances are not intended to be included in the official City Code.
   SECTION 4: It shall be unlawful for any person, firm or corporation to change or amend by additions or deletions, any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any manner whatsoever which will cause the law of the City to be misrepresented thereby.
   Any person, firm or corporation violating this Section shall be punished as provided in Section 1-4-1 of the City Code of Sandpoint, Idaho.
   SECTION 5: All ordinances or parts of ordinances in conflict herewith, are, to the extent of such conflict, hereby repealed.
   SECTION 6: This Ordinance and this Code adopted by the same shall be in full force and effect upon publication of this Ordinance according to law in the Bonner County Sandpoint Daily Bee, a newspaper of general distribution in the City of Sandpoint, Idaho, and hereby declared to be the official newspaper for the publication of this Ordinance.
   Passed and adopted as an ordinance of the City of Sandpoint, Idaho, at a special session of the Sandpoint City Council on the 7th day of March, 2001.
