§ 12.1601   Establishment.
   There is established the San Bernardino County Airports Commission.

§ 12.1602   Appointment of Commission Members.
   The Airports Commission shall consist of seven members. The Board of Supervisors shall appoint one commissioner for each supervisorial district. The commissioner for each district shall be recommended and, nominated by the supervisor for that district. The Board of Supervisors shall also appoint two at-large commissioners, one from the Mountain-Desert area, and one from the San Bernardino Valley area. The at-large commissioner from the Mountain-Desert area shall be recommended and nominated by the supervisor for the First Supervisorial District, after consultation with the supervisor for the Third Supervisorial District. The at-large commissioner from the San Bernardino Valley area shall be recommended and nominated by the supervisor for the Fourth Supervisorial District, after consultation with the supervisor for the Second Supervisorial District. Each appointment shall be by majority vote of the Board of Supervisors. Commissioners must be residents of the County of San Bernardino. Notwithstanding San Bernardino County Code § 12.1603, Terms of Appointment, commissioners serve at the pleasure of the Board of Supervisors and their term of appointment is subject to the provisions of San Bernardino Code § 12.3701, Termination of Office.

§ 12.1603   Terms of Appointments.
   Appointments shall not exceed four years in length and the terms of office shall be staggered to insure that no more than two-thirds of the terms shall expire in any one-year period. Terms shall expire on January 31 of the appropriate year and subsequent new terms shall begin February 1 of that year. Members who have served two consecutive full terms may not be reappointed to the Commission for a period of two years unless authorized by specific Board of Supervisors’ action.
   A Commissioner whose term of office has expired shall continue to serve in that capacity until a new appointment is made or the Board of Supervisors declares that position vacant. All final appointments shall be made for either a full term or the completion of an unexpired term. Any appointment to fill an unexpired term of office shall be considered a full term if the appointee serves for three years or more of that unexpired term.

§ 12.1604   Duties and Responsibilities of the Airports Commission.
   The Commission shall abide by all applicable laws and have the responsibility to publicly review and discuss those matters it has been requested to review and comment upon by the Board of Supervisors or the Economic Development and Public Services Group. All resolutions, motions, or other comments made by the Commission may be reviewed by the Department of Airports of the Economic Development and Public Services Group and comments, if any, will be appended to the Commission recommendations prior to forwarding to the Board for action.
   The Commission is not authorized to sign contracts, disburse funds, implement programs, employ or consider any personnel matters or act in any other capacity that involves the direct management or operation of the San Bernardino County airports system. The Commission may be asked for recommendations with regard to the selection and hiring of the Director of Airports for the County.
   The Commission will have the following specific duties and responsibilities:
   (a)   Make such recommendations and observations concerning County airports and aviation-related issues to the Board of Supervisors and/or the Economic Development and Public Services Group, as the Commission may, from time to time, deem appropriate;
   (b)   Review proposals for airport leases as required or when otherwise deemed appropriate by the Director or the Commission, and make recommendations regarding approval by the Director or the Board;
   (c)   Promote airports and aviation in general in San Bernardino County;
   (d)   Review and participate in County airport special events and recommend appropriate Board action;
   (e)   Review and make recommendations for initial preparation of the annual airports budget and the five-year and ten-year capital improvement budgets, and review and make recommendations for the initial preparation of the year-end budget estimate;
   (f)   Review and make recommendations for appropriate action on rental delinquencies or lease defaults requiring possible legal action and/or termination by the Board.
   The Commission shall meet monthly, unless it is determined by the Chairperson of the Commission and not less than three other members of the Commission that less frequent meetings will satisfy the above-described duties and responsibilities. For good cause, the Chairperson may call a special meeting of the Commission.
   (g)   Augment the County Planning Commission when required in accordance with the provisions of Chapter 41 of this division and title.

§ 12.1605   Commissioner Qualifications.
   Each member of the Commission shall possess extensive experience and expertise in one or more phases of aviation or airport activities, by virtue of substantial participation therein for at least one year, but in lieu of such qualification not more than two members may be similarly qualified by substantial experience and responsibility in the fields of construction engineering or commercial/industrial management.

§ 12.1606   Compensation of Commissioners.
   Each member of the Commission shall serve with no other compensation than that authorized by law in the County salary ordinance, and shall be allowed their actual and necessary travel expenses incurred in the discharge of official duties within the County, and, with prior approval of the Board of Supervisors, outside the County, in accordance with the County Travel Code.

§ 12.1607   Director of Airports’ Relationship to Airports Commission.
   It shall be the duty of the Director of Airports, in his or her relationship with the Airports Commission, subject to policy direction of the Board of Supervisors and within the limits of the applicable laws, ordinances and regulations to:
   (a)   Attend meetings of the Commission and serve as Secretary of the Commission, without vote;
   (b)   Advise and inform the Airports Commission regarding airport and aviation related issues, growth and development that may affect the County and/or operation of the County airports;
   (c)   Forward the advice and recommendations of the Commission through the Economic Development and Public Services Group, to the Board of Supervisors, and keep the Commission advised of the Board’s actions and requests.
