331.44 PROHIBITION ON USE OF ENGINE RETARDING DEVICES OR ENGINE COMPRESSION BRAKES.
   (a)   For purposes of this section, the term engine retarding device or engine compression brake shall mean any engine brake of the type designed to be mounted on a motor vehicle engine which changes the action of the exhaust valves, and provides retarding power which is proportional to the engine’s Revolutions per Minute (RPM) so as to slow the motor vehicle.
   (b)   No person while operating a motor vehicle within the City of Salem shall activate an engine retarding device or compression brake on such motor vehicles unless the other braking devices on such motor vehicle shall have failed or exigent circumstances exist which require the use of such device.
   (c)   Any person who violates this section shall be fined not more than one hundred dollars ($100.00) per offense with each use of such engine retarding device or engine compression brake constituting a separate offense.
