1311.99 VIOLATIONS AND PENALTIES.
   Whoever violates provisions 1311.03(c) and 1311.04 of this Chapter or fails to comply therewith, or violates or fails to comply with any order thereunder or any certificate or permit issued thereunder, from which no successful appeal has been taken shall be guilty of a misdemeanor of the first degree and shall be fined not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1,000), and/or imprisoned for not more than six (6) months. Whoever violates provisions 1311.03(d)(1) and (2) of this Chapter or fails to comply therewith, or violates or fails to comply with any order thereunder or any certificate or permit issued thereunder, from which no successful appeal has been taken shall be guilty of a misdemeanor of the fourth degree for a first offense and shall be fined not more than two hundred fifty dollars ($250.00) and/or imprisoned for not more than thirty (30) days. A second violation of the same provision by the same property owner at the same property shall be a misdemeanor of the third degree and shall be subject to a fine of not more than five hundred dollars ($500.00) and/or imprisoned for not more than sixty (60) days. A third violation, or thereafter of the same provision by the same property owner at the same property shall be a misdemeanor of the first degree and shall be subject to a fine of not less than five hundred dollars ($500.00) or more than one thousand dollars ($1,000), and/or imprisoned for not more than six (6) months. Whoever violates provisions 1311.03(d)(3),(4) and (5) or violates and fails to comply with any order thereunder or any certificate or permit issued thereunder to which no successful appeal has been taken or fails to comply within the time required by law shall be guilty of a minor misdemeanor and/or fined not more than one hundred fifty dollars ($150.00). A separate offense shall be deemed committed for each day said violation exists. Penalties for violations under this Section shall not be construed as a limitation to any other remedies available to the City.
