Any person aggrieved by any order of the Enforcing Official, pursuant to this Chapter shall have the right to appeal to the Board of Zoning Appeals. Such appeal shall be taken within ten (10) days of the Declaration of Public Health Hazard, by filing with the Enforcing Official a written notice of appeal and stating the grounds thereon. A non-refundable fee of one hundred dollars ($100.00) shall be paid to the City of Salem for said appeal upon filing.
(a) Upon receipt of an appeal, the Enforcing Official shall call a meeting of the Board of Zoning Appeals within a reasonable time, not to exceed thirty (30) days for the hearing of the appeal. All other provisions of Codified Ordinances, Chapter 1139.02 shall prevail in addition to the By-Laws of the Board of Zoning Appeals.
(b) In addition to the powers of the Board of Zoning Appeals found in Codified Ordinances, Chapter 1139.04, the following powers shall be vested in the Board of Zoning Appeals relative to this Chapter, being:
(1) To hear and decide appeals where it is alleged there is an error in any order, requirement, decision of determination made by the Enforcing Official in the enforcement of this Chapter.
(2) The provisions of this Chapter do not apply, or the requirements of this Chapter are adequately satisfied by other means.
(3) The Board of Zoning Appeals shall affirm, reverse or modify the decision of the Enforcing Official by a majority vote of the members.
