747.12 DENIAL OF SWEEPSTAKES TERMINAL CAFÉ LICENSE.
   A Sweepstakes Terminal Café License shall not be issued or renewed for any business or premises for any of the following:
   (a)    Where the premises are located in any Zone District other than a C-2 General Commercial, C-3 Central Commercial, M-1 Light Industrial or M-2 Heavy Industrial.
   (b)    Where the premises do not specifically designate at least 30 gross square feet of floor area for each Sweepstakes Terminal Device to be located upon the premises, excluding areas used for other principal uses.
   (c)    Where the premises do not provide a minimum of thirty (30) off-street parking places, or 1 parking space for every two Sweepstakes Terminal Devices, whichever is greater. A Sweepstakes Terminal Café located within the C-3 Central Commercial Zone District is exempt from this provision.
   (d)    Where the premises are located within one thousand (1000) feet of a school, public library, church, religious institution or public playground or any establishment that has been issued a liquor permit by the State of Ohio.
   (e)    Where it is determined that the premises or operation would be in violation of any provision of the Ohio Basic Building Code, the Zoning Code, Fire Code, State Health Code or any other pertinent provision of any local, state or federal law.
   (f)    Where any of the owners or operators have been convicted within the last five (5) years of any felony, a misdemeanor involving minors, a misdemeanor involving moral turpitude or a crime of violence, or a misdemeanor involving any gambling activity, controlled substance or alcoholic beverages.
   (g)    Where the applicant made a false statement on the application or in a hearing concerning the license.
   (h)    Where the application failed to provide all the required information.
   (i)    Where the owner, operator and/or applicant fails to comply with all terms and conditions under this chapter and all other applicable ordinances, laws, rules and regulations.
