(a) There shall be a limit of four (4) Sweepstakes Terminal Café Licenses issued in the City of Salem.
(b) A Sweepstakes Terminal Café license fee, payable to the City of Salem at the time of application and annually thereafter shall be five thousand dollars ($5,000.00) for each business location per year with such fee due on or before January 1st of each year. The license fee shall be prorated for the balance of any calendar year remaining from the date of application for new applicants. Any existing Sweepstakes Terminal Cafes in operation at the time this chapter is enacted shall have the license fee prorated from September 1st to December 31st for the calendar year 2011. In the event that an application is denied under this Chapter, one-half (½) of the application fee shall be returned to the applicant. In the event that a license is revoked or suspended hereunder, no portion of the license fee shall be returned.
(c) The fee for each Sweepstakes Terminal Device shall be $0 for each device on the premises for each year or any part thereof ending on December 31 of each year.
(d) The fees, which are paid at the time of application, are not refundable in any case. The license fee shall be paid for each device brought to the facility before the device is put into use. For purposes of determining licensing fees, each device that is operable by one or more person is a separate device.
(e) Licenses issued under this Chapter shall not be transferable to any other person, partnership, corporation, or other entity and the business may be conducted only at the location for which the license is issued. The license must be so placed as to be made conspicuously visible and shall list each device with serial number.
(f) Failure to register any Sweepstakes Terminal Device before placement on the premises is an unclassified misdemeanor and the operators shall each be liable for a mandatory fine of one hundred fifty dollars ($150.00) per device for each day the device is not registered, and said fine shall not be reduced or suspended.
