747.03 DEFINITIONS.
   For the purpose of this Chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   (a)    Computerized Sweepstakes Device means any computer, machine, game or apparatus which, upon the insertion of a coin, token, access number, magnetic card, or similar object or upon the payment of anything of value, a product or service is provided, and may be operated by the public generally for use as a contest of skill, entertainment or amusement, whether or not registering a score, and which in no way tends to promote or encourage gambling.
   (b)    Sweepstakes Terminal Café means any premises upon which any computerized sweepstakes device is located for the use or entertainment of the public, whether or not such premises have other business purposes of any nature whatsoever.
   (c)    Owner means any person who possesses a pecuniary interest, either directly or indirectly, of twenty-five percent (25%) or more in a Sweepstakes Terminal Café.
   (d)    Operator means any person or persons having authority to control the premises of a Sweepstakes Terminal Café.
   (e)    Franchise Holder means any person or persons who, through payment of anything of value, buys, leases or through any other means is a franchise owner of a Sweepstakes Terminal Café.
   (f)    Person means any natural person, firm, partnership, association, corporation or any other form of business organization.
   (g)    Licensee means the person, persons or organization who signs an application for a license and to whom such license is issued.
   (h)    Zoning Officer means the person responsible for enforcement of this Chapter.
   (i)    Board means the Salem City Board of Zoning Appeals.
   (j)    Premises means the building or portion of building used to conduct or operate a Sweepstakes Terminal Café.
   (k)    School means any education institution, private, secular, or parochial, which offers instruction to preschool age children, elementary through high school education, and/or colleges and universities of higher education, technical schools, arts and music schools and other speciality schools, and includes day care operations.
