When an authorized Municipal Fire Safety Inspector determines that there has been a violation of any provision of this Code or any section of the Ohio Fire Code (OFC), Ohio Administrative Code (OAC), or Ohio Revised Code (ORC) referenced and adopted herein, such inspector shall serve a written notice of violation upon the persons responsible therefor. Such notice shall:
(a) Include a list of violations referring to the section of Code violated;
(b) Describe the building, unit, structure or premises where the violations exist or have been committed;
(c) Contain an outline of remedial action which, if taken, will effect compliance with the provisions of the Code;
(d) Set a reasonable time for compliance, normally not to exceed thirty days unless the Municipal Fire Safety Inspector deems it necessary to allow more time. After the allotted time has expired, a reinspection will be conducted to determine compliance. If compliance has not been met, then a date will be set by the Municipal Fire Safety Inspector for a second reinspection. A fee of fifty dollars ($50.00) will be paid by the owner or landlord for the second reinspection. Each additional reinspection will have a fee increase of fifty dollars ($50.00). Thus, the third reinspection fee will be one hundred dollars ($100.00), the fourth reinspection fee will be one hundred fifty dollars ($150.00) and shall continue to increase by fifty dollars ($50.00) for each subsequent reinspection.
(e) Nonpayment of Fees: In the event the owner or landlord fails to pay the reinspection fee or fees within thirty (30) days of being so notified of such cost by the Municipal Fire Safety Inspector, the unpaid fee shall be certified by the City to the Auditor of Columbiana County, to be placed upon the tax duplicate for collection as a special assessment.
