1309.99 PENALTY.
      (a)    Any person who violates any provision of this Housing Code is guilty of a minor misdemeanor. Each day’s failure to comply with any such provision shall constitute a separate minor misdemeanor violation. Second or subsequent violations of the same section of this Code at the same affected property by an owner, his agent or the occupant, shall constitute a misdemeanor of the fourth degree requiring a mandatory court appearance.
   (b)    The Law Director is hereby authorized and empowered in cases of flagrant, continued or repeated violations of this Housing Code, to apply to a court of competent jurisdiction for an order enjoining the owner or any other person or persons from inhabiting or otherwise occupying the dwelling or dwelling unit, or room wherein such violation exists.
   (c)    Minor housing code infractions may be waived with the consent of all interested parties, namely the housing code official, the landlord and the tenant.
   (d)    Failure of the owner, landlord or tenant to permit an authorized inspection pursuant to Section 1309.04 and Section 1309.10 herein shall resultin a fine of not less than one hundred dollars ($100.00) with said fine being increased to a minimum of two hundred dollars ($200.00) fine for any subsequent offense. Each day that said owner, landlord or tenant fails to permit an authorized inspection shall constitute a separate offense.
